19.1003 The Planning Conmission shall grant a variance only when <br /> the following findings are made: <br /> <br /> 1) That such variance is necessary for the preservation and enjoy- <br /> merit of substantial property rights possessed by other properties <br /> in the same zoning district and in the same vicinity. <br /> <br /> 2) That such variance will not be of substantial detriment to <br /> adjacent property, and will not materially impair the purposes <br /> of this ordinance or the public interest. <br /> <br /> 19.10])4 No grant of a variance shall be authorized unless the <br /> Commission specifically finds that the condition or situation of the <br /> specific piece of propert-y, or the intended use of said property, for <br /> which variance is sought (or one or the other in combination) is not <br /> so general or recurrent a nature as to make reasonably practicable the <br /> formulation of a general regulation for such conditions or situtatton o <br /> <br /> 19.1005 The Commission shall act upon any application within 45 <br /> days and may approve such variance or may grant variance subject to <br /> specified conditions. <br /> <br /> 19.1006 Unless specified o~hervise at ~he time variance is granted, <br /> ~he variance applies to subject property for an indefinite time and <br />· is transferable to any future owner of subject property. <br /> <br /> 19.1100 .Appeals. The purpose of appeal procedure is to provide <br /> recourse in case it is alleged that there is error in any order, require- <br /> ment, permit, decision or determination made by an administrative official <br /> or advisory body in the administrative official or advisory body in the <br /> administration or enforcement of this ordinance. <br /> <br /> 19.1101 Any person aggrieved by the action of an administrative official <br /> or advisory body in ~be administration or enforcement of this ordinance <br /> may make application to the City Clerk in the manner prescribed by the <br /> City Council within 7 days from the date of the action that is appealed. <br /> <br /> 19.1102 Application shall be accompanied by a verification by at <br /> least one of the pettCianers, attested before a Notary Public or other per- <br /> son authorized by law to administer oaths, or by a sworn declaration. <br /> <br /> 19.1103 A public hearing shall be held by the City Council within <br /> 30 days from the date of appeal. Notice of time, place and purpose of <br /> the hearing shall be given by the City Clerk as required heretofore. <br /> <br /> 19.1104 A full record in writing shall be submitted by the officer <br /> of body whose action is appealed, setting forth reasons for action taken. <br /> <br /> 19.1105 The Council shall find whether in its opinion error was <br /> made, <br />~' 19,1106 The Council may affirm, reverse or modify the action ap- <br /> pea~ed, as it deems just and e~uitable, end exercise all rights of <br /> other officer or commission. <br /> 19.1107 ~ction of the Ci~ Council may be reviewed by competent <br /> courts. <br /> <br /> <br />
