<br />Wireless Telecommunications Facilities Policy (City of Pleasanton) page 6 / 37 <br />(bb) “Wireless Facility Permit” means the permit approval required by the City of <br />Pleasanton Community and Economic Development Department to authorize the <br />use of wireless facilities subject to this policy. <br /> <br />(cc) “Zoning Administrator” means the same as defined in Section 18.08.010 of the <br />Municipal Code, or their designee. <br /> <br />Section 4. APPLICABILITY <br /> <br />(a) General. This policy applies to all requests for the City’s regulatory authorization <br />to construct, install, operate, collocate, modify, relocate, remove or otherwise <br />deploy wireless facilities within the City’s territorial and jurisdictional boundaries, <br />unless expressly exempted pursuant to this Section 4. <br /> <br />(b) Wireless Facilities on City Property or Structures. This policy applies to permit <br />applications, submitted to the City in its regulatory capacity as the permitting <br />agency, for wireless facilities on property or structures owned or controlled by the <br />City; provided, however, that this policy does not govern whether or under what <br />terms and conditions the City, in its proprietary capacity as the property or structure <br />owner, would lease, license or otherwise allow a wireless facility on such property <br />or structures. <br /> <br />(c) Small Wireless Facilities; Eligible Facilities Requests. Notwithstanding <br />anything in this policy to the contrary, this policy shall not be applicable to small <br />wireless facilities, eligible facilities requests and/or other applications submitted for <br />approval pursuant to Section 6409. <br /> <br />(d) Other Exemptions. Notwithstanding anything in this policy to the contrary, this <br />policy shall not be applicable to the following: <br /> <br />(1) wireless facilities operated for public purposes by the City or through joint <br />powers authorities that the City is a member; <br /> <br />(2) wireless facilities installed completely indoors and used to extend personal <br />wireless services into a business or the subscriber’s private residence, such as <br />a femto cell or indoor distributed antenna system; <br /> <br />(3) OTARD antennas; <br /> <br />(4) antennas and related transmission equipment used in connection with a duly <br />authorized amateur station; or <br /> <br />(5) wireless facilities or other transmission equipment owned and operated by <br />CPUC-regulated electric companies for use in connection with electrical power, <br />generation, transmission and distribution facilities subject to CPUC General <br />Order 131-E. <br />Docusign Envelope ID: 51CE5BDE-55F1-4B3D-8865-17E5814CF0C5
