Resolution No. PC-2026-06 <br />Page 5 of 6 <br /> <br /> <br /> <br />7. The plan conforms to the purposes and intent of the PUD District <br /> <br />PUD-25 was approved following a comprehensive planning process that established <br />specific development standards for detached accessory structures, including the 20-foot <br />street-side yard setback for corner lots. These standards were intentionally adopted to <br />preserve neighborhood character and maintain a consistent development pattern <br />throughout the subdivision. <br /> <br />To date, no modifications to the street-side yard setback requirement have been approved <br />within PUD-25. Approving a reduction from 20 feet to 8 feet —less than even PUD-25’s 10- <br />foot interior side-yard setback requirement—would represent a significant departure from <br />the adopted standards and could establish a precedent for future deviations that would <br />incrementally erode the integrity of the PUD framework. <br /> <br />Accordingly, the Planning Commission recommends that the City Council determine that <br />the Project does not conform to the purposes and intent of the PUD District, and the City <br />Council cannot make this finding. <br /> <br />Section 5: The Planning Commission hereby recommends that the City Council deny the <br />appeal of Case No. PUD-25-02M, the application of Tim Nystrom of NYS Architecture, as the <br />applicant, on behalf of the property owner Terence Tung, for a Minor PUD Modification to <br />reduce the required street-side yard setback from 20 feet to eight feet to accommodate the <br />construction of a detached accessory structure located at 1011 Vista Oaks Court. <br /> <br />Section 6: The Planning Commission recommends that the City Council direct the Planning <br />Manager to file a Notice of Exemption with the Alameda County Clerk. <br /> <br />Section 7: This resolution shall become effective 10 days after its passage and adoption. <br /> <br />PASSED, APPROVED, AND ADOPTED by the Planning Commission of the City of <br />Pleasanton at a regular meeting held on March 25, 2026, by the following vote: <br /> <br />Ayes: Commissioners Jagoe, Jain, and Chair Pace <br />Noes: <br />Absent: <br />Abstain: Commissioners Morgan and Wedge <br /> <br />ATTEST: <br /> <br /> <br />_____________________________ ______________________________ <br />Derek Farmer Brandon Pace <br />Secretary, Planning Commission Chair <br /> <br /> <br /> <br /> <br />Docusign Envelope ID: 258AEAD3-D649-4183-A554-D5096B1FBE83
