Even though at this Sept 2003 hearing where no speakers voiced concern <br />over the late operating hours (vs. this time when there were several), at that time the Sept <br />2003 vote was 3 (Kameny, Roberts, Maas) to 2 (Sullivan, Ark/n) contingent upon the applicant <br />having a legally binding valet parking agreement. <br /> <br />Also, please note that though the Staff Report did not explicitly highlight differences in the <br />proposed and previous project, that the project has a significant change from the original one <br />proposed in Sept 2003. When Mr. Iserson originally brought this to the Planning Commission on <br />Sept 2003, during the summary and in the minutes, Mr. Iserson noted that there would be no live <br />entertainment, and that the background recorded music would not create a noise impact. In the <br />new location on St Mary's Street, the applicant is proposing live bands or DJ music on Friday and <br />Saturday from 9:45 PM to 1 AM. There are also differences regarding parking...in the previous <br />proposal, the site had 20 dedicated on-site parking spaces with a plan to supplement with 23 <br />more spaces for offsite and valet parking. The current proposal relies on the proximity of a public <br />parking lot. <br /> <br />In the previous Sept 2003 meeting minutes, the Crown's proposed owner indicated "IQ rcspoQsc <br />to an inquiry by Commissioner Sullivan, Ms. Kay replied that the Danville pub was open <br />until 2:00 a.m., but that they often closed by 1 a.m. during the week. She noted that they <br />often closed at 10:30 p.m. from Monday to Wednesday, and at midnight on <br />Thursday." Thus in the latest Planning Commission hearing, given the previous comments, I felt <br />that the restaurant/pub could close at 11 PM on weekdays with no detrimental business impact <br />(given in practice they close earlier in Danville anyway). <br /> <br />Also, please also ensure that the City Council has information that Heidi provided to me verbally <br />outside of the hearing regarding what the ordinances in regards to restaurants mean....that <br />closing time does not mean the patrons leave by that time....such that if a restaurant closes at <br />midnight and patrons arrive 5 or 10 minutes before closing their doors, patrons can order and <br />then leave the establishment much later. <br /> <br />Thanks, <br /> <br />Anne Fox <br /> <br />p,s.
