CONCLUSION

The application raises the question of the appropriate interface between businesses and
residences in the Downtown, and staff and the PDA believe that the applicant's restaurant/bar in
the Downtown will be a benefit to the area and that businesses on or close to Main Street should
be allowed to remain open late as long as they operate in a manner which respects the nearby
residents. While the adjacent residences are entitled to a reasonable quality of life, their location
near the Downtown commercial district means they are exposed to a greater degree of spillover
impacts such as traffic, parking, noise, etc. than a typical residential neighborhood. The City
tries to minimize these impacts, but at times some impacts at the residential/commercial
interface are difficult to avoid, and it may not be realistic for neighbors to expect the same level
of peace and quiet as those who live further from Downtown's commercial area. With the
current application, staff believes that the applicant's proposal as conditioned will be a benefit to
the area and that the surrounding uses would not be impacted due to noise, parking, litter, or
other objectionable influences.

The subject building has been vacant for several years and has visible signs of disrepair. Staff
believes that the proposed use will enable the building owner to follow through with the
building refurbishment/remodel plans approved this past summer and place this historic building
in operation once again.

STAFF RECOMMENDATION

Staff recommends that the City Council adopt the attached draft City Council resolution denying
the appeal and, therefore, approving Case PCUP-129 subject to the conditions listed in Planning
Commission Resolution No. PC-2004-69.

Respectfully Submitted,

Jerry Iserson, Director of
Planning and Community
Development

Susan Rossi
Director of Finance

Nelson Fialho
City Manager

SR:05:023
Page 9
