<br />Resolution No. PC-96-70 <br />Page 3 <br /> <br />EXHIBIT "B" <br />Conditions of Approval <br />Case Z-96-125 <br /> <br />PLANNING <br /> <br />1. Development shall be substantially as shown on the development plans and colorboard, <br />Exhibit "A", dated "Received August 30, 1996" on file with the Planning Department, <br />except as modified by the following conditions. Minor changes to the plans may be <br />allowed subject to the approval of the Planning Director if found to be in substantial <br />conformance to the approved exhibits. <br /> <br />2. The applicants shall obtain all building and other applicable City permits for the project <br />prior to the commencement of construction. <br /> <br />3. The developer shall pay any and all fees to which the property may be subject prior to <br />issuance of building permits. The type and amount of the fees shall be those in effect at <br />the time the building permit is issued. <br /> <br />4. No building permit for residential units shall be issued unless the City has granted growth <br />management approval pursuant to Chapter 17.36 of the Pleasanton Municipal Code and <br />such approval is in effect at the time the building permit is issued. <br /> <br />5. Nine of the off-street parking spaces provided on the site shall be reserved exclusively for <br />the use of the residents of the eight apartment units on the site. Signs, including <br />stenciling of the parking spaces, indicating the restriction of parking shall be posted at the <br />driveway entry and adjacent to the parking spaces. The quantity, content, design, and <br />placement of the signs, shall be subject to review and approval by the Planning Director <br />prior to the issuance of building permits. <br /> <br />6. The applicants shall agree to negotiate in good faith with the City and Bank of America <br />to consolidate and/or join the parking lot of the subject development with the adjacent <br />Bank of America parking lot at 337 Main Street. <br /> <br />7. The applicants shall enter into an in-lieu parking agreement in accordance with the <br />Municipal Code provisions for twelve (12) parking spaces for this project. Said <br />agreement shall be approved by the City Council prior to issuance of a building permit <br />for the project. If approved by the City Council, the agreement would include "credits" <br />for five (5) parking spaces on the applicants' lot that would be made available to the <br />general public, may provide for a deferred payment of the in-lieu fee until such time as a <br />public parking lot is constructed in the vicinity of the project site, may include provisions <br />for payments to be spread out over several years, and may include "credits" for <br />constructing some or all of the necessary improvements to consolidate the parking lot of <br />the subject development with the adjacent Bank of America parking lot at 337 Main <br />Street. <br />
