Prior to the issuance of building permits, the developer shall submit for the review and
approval of the City Engineer and Planning Director a preliminary street design for
Owens Drive between Hopyard Road and Johnson Drive to allow additional stacking
length for the left turn lanes at the Owens Drive/Hopyard Road intersection for vehicles
east bound on Owens Drive turning northbound on Hopyard Road. The developer shall
dedicate all necessary right-of-way to widen Owens Drive across the project frontage in
accordance with these plans.

82. The developer shall design and construct a median island in the primary Owens Drive
driveway shared with Denny's (opposite the median break in Owens Drive) to function as
a right-turn-out only driveway onto Owens Drive should future traffic or safety
considerations require elimination of eastbound left turns as determined by the City
Engineer.

83. Each building shall be supplied with an individual sanitary sewer and water lateral. The
exact locations of water meters and backflow devices shall be indicated on the civil
drawings submitted for building permits and shall be subject to the review and approval
of the City Engineer prior to issuance of building permits.

84. Unless otherwise approved by tlte City Engineer, the developer shall utilize the existing
utilities stubbed to the site and no new street cuts for utilities shall be permitted. No trees shall be located within any of the City's on-site utility easements unless
otherwise approved by the City Engineer. The developer shall enter into an agreement
with the City agreeing to replace any trees in the event that the trees must be removed or
are damaged if a utility must be unearthed, and agreeing to repair any damage to the
utility caused by tree roots. Said agreement shall be approved by the City Attorney and
executed prior to issuance of any building permits.

87. The on-site storm drain system shall be private and shall comply with the City's non-point
discharge ordinance including the installation of sand and oil separators.

88.
