The developer shall plant additional trees in the landscape area located between the fourth <br />and fifth parking row on a 20' 0' spacing in a single row to create a continuous tree row. <br />This detail shall be shown on the revised landscaping plan provided for review and ap- <br />proval by the Planning Director before issuance of a building permit <br /> <br />10. Before occupancy the applicant shall stencil the parking spaces located immediately in <br />front of the Bank of America building with the wording: "Parking for Bank of America <br />Customers Only". The applicant shall work with representatives of the bank to determine <br />which spaces shall be stenciled. This detail shall be shown on the revised site plan pro- <br />vided for review and approval by the Planning Director before issuance of a building per- <br />mit. <br /> <br />II. The applicant shall provide to the Manager of the Bank of America at least 30-days writ- <br />ten notice prior to beginning work in the bank's parking area. A copy of this notice shall <br />be provided to the Planning Director and to the City Attorney. <br /> <br />12. The applicant shall add spandrel glass to the building walls having the arch elements in <br />an alternating pattern above the arches. This detail shall be shown on the revised building <br />elevations for review and approval before issuance of a building permit. <br /> <br />13. The design and materials used on the project's trash enclosure shall match the sloped, <br />standing seam metal roof used on the project's entry feature. This detail shall be shown <br />on the revised building elevations provided for review and approval by the Planning Di- <br />rector before issuance of a building permit. <br /> <br />14. The property owner or its successors in interest (owner) shall enter into a deferred im- <br />provement agreement with the City of Pleasant on (City) to provide that: <br /> <br />a. the owner shall either not protest the establishment of an assessment district, or <br />shall affirmatively vote for the creation of the district or other mechanism to pay the <br />construction costs for the I-680fWest Las Positas Boulevard freeway interchange, <br />depending on the manner of creation of the funding mechanism; <br /> <br />b. the owner retains the right to protest that the allocation of costs among various <br />properties is inequitable under the above-mentioned funding mechanisms; <br /> <br />c. in the event the assessment mechanism appears to impose economically infeasible <br />levels of costs upon the site, the City agrees to explore alternative financing meth- <br />ods; and <br /> <br />d. if, with consent by the owner, Section VIII of the previous agreement between the <br />City and Robert E. Meyer, dated June 22, 1982 and recorded as Document No. <br />82-140679, is substantially changed so that it no longer coincides with the wording <br />of this condition, that this condition shall be superseded by the revised agreement. <br />
