The proposed conditional use will comply with each of the applicable <br />provisions of this chapter. <br /> <br />The proposed conditional use is required to comply with all applicable <br />sections ofthe Pleasanton Municipal Code governing properties zoned <br />Service Commercial. Staffhas recommended, and the Planning <br />Commission may add, other conditions for the operation of the storage <br />yard to ensure its compliance with the City's zoning ordinance and <br />objectives. By complying with the recommended conditions of approval, <br />the storage yard would meet the criteria for receiving a conditional use <br />permit and would, therefore, comply with the intent of the zoning <br />ordinance. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed storage yard is consistent <br />with the overall development pattern ofthe surrounding area. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section I. <br /> <br />Section 2 <br /> <br />Approves Case UP-96-39 and Z-96-178, the application of Via com Cable, for a <br />conditional use permit and design review approval to operate an outdoor storage <br />yard for electrical construction supplies located at 3744 Old Santa Rita Road, <br />subject to the conditions shown in Exhibit "B," attached hereto and made part of <br />this case by reference. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br /> <br />THIS RESOLUTION ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON ON THE 14TH DAY OF AUGUST 1996 BY THE FOLLOWING VOTE: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Barker, Cooper, Dove, Wright, and Chairman Lutz <br />None <br />Commissioner McGuirk <br />None <br />
