<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-96-57 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF VIACOM CABLE FOR A <br />CONDITIONAL USE PERMIT AND DESIGN REVIEW APPROVAL, AS FILED <br />UNDER CASE UP-96-39 AND Z-96-178 <br /> <br />WHEREAS, Viacom Cable has applied for a conditional use permit and design review <br />approval to operate an outdoor storage yard for electrical construction supplies <br />located at 3744 Old Santa Rita Road; and <br /> <br />WHEREAS, zoning for the property is C-S (Commercial Service) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of August 14,1996, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives ofthe zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The site is zoned C-S Service Commercial. Construction storage yards are <br />conditionally allowed uses in this zoning district. In the context of the <br />surrounding area, characterized by other conditionally allowed C-S type <br />uses, e.g., automotive storage and wrecking yards, automotive repair, <br />cellular communication facilities, etc., the proposed storage yard is <br />consistent with this zoning district. <br /> <br />B. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />The storage yard is considered to have an Insignificant visual impact on <br />surrounding properties and to Old Santa Rita Road. The storage and <br />wrecking yards and similar uses located on Old Santa Rita Road are <br />located on sites enclosed by chain-linklbarbed wire fences. Since it is <br />consistent with the area's prevalent pattern, staff believes that the <br />appearance of the barbed wire does not conflict with the purposes of the <br />Municipal Code and, would not be detrimental to the public health or <br />general welfare. The applicant has agreed to plant shrubs as temporary <br />landscaping between the fence and curb on Old Santa Rita Road. <br />
