The use and operation of the building located at 6180 Embarcadero Court for a restaurant, <br />bar, and billiard parlor, from II :00 a.m. to 2:00 a.m. daily shall substantially conform to <br />conceptual floor plan and statements of operation, Exhibit" A", dated "Received July 19, <br />1996" on file with the Planning Department, except as modified by the following <br />conditions. In the event that the applicants propose to modify the hours of operation or the <br />business as specified in the operation details, the modification shall be subject to the review <br />and approval by the Planning Director. The Planning Director may refer the matter to the <br />Planning Commission for its review and action. Minor changes may be allowed subject to <br />the approval of the Planning Director iffound to be in substantial conformance to the <br />approved use permit. <br /> <br />2. IfPUD-81-22-8M, the PUD Development Plan modification submitted in conjunction with <br />the subject conditional use permit for the proposed restaurant, bar, and billiard parlor is <br />denied or expires, then the subject conditional use permit shall also expire with no further <br />legal force or effect. <br /> <br />3. This conditional use permit approval will lapse within one (I) year from the date of <br />approval unless a building permit is issued and construction has commenced and is <br />diligently pursued toward completion or an extension has been approved by the City. <br /> <br />4. In the event that the operation of the bar and billiard parlor results in conflicts and/or <br />nuisances pertaining to parking, noise, traffic, drunkenness, rowdy behavior, or other <br />impacts to occur within the building and/or outdoors in the vicinity of the site, at the <br />discretion of the Planning Director, this conditional use permit may be referred to the <br />Planning Commission for subsequent review at a public hearing. If necessary, the Planning <br />Commission may modify or add conditions of approval to mitigate such impacts, or may <br />revoke said conditional use permit. <br /> <br />5. The operation of the establishment shall comply with all applicable Fire, Building, and <br />Public Health Codes, to the satisfaction of the Fire Marshall, the Director of Building <br />Inspection, and representatives of the Alameda County Health Department. <br />Non-compliance with these codes may result in Planning Commission review and, if <br />necessary, revocation of this conditional use permit per Section 18.124.130 of the <br />Pleasanton Municipal Code. <br /> <br />6. The applicants shall provide indoor and outdoor security during business hours. The <br />number and duty-time of security personnel shall be reviewed and determined by the Chief <br />of Police prior to issuance of a building permit. <br /> <br />7. The developers shall maintain the site and area surrounding the building in a clean and <br />orderly manner at all times. <br />
