The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />The location of the proposed restaurant/sports barlbilliard parlor would, <br />provide adequate separation from the nearby Stoneridge Apartments <br />buildings. From a subjective level, the request for live and recorded <br />music would not impact the residents living in these apartments. Given <br />the availability of parking on-site and at the Stoneridge Corporate Center, <br />there would be more than adequate parking available for the employees <br />and customers of the proposed restaurant/sports barlbilliard parlor during <br />its operation. The restaurant/sports barlbilliard parlor is required to abide <br />by the occupancy requirements of the Uniform Building Code and the <br />City's Fire Code. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of this chapter. <br /> <br />The proposed conditional use is required to comply with all applicable <br />sections of the Pleasanton Municipal Code governing the subject property. <br />By complying with the recommended conditions of approval, the proposed <br />establishment would meet the criteria for receiving a conditional use <br />permit and would, therefore, comply with the intent of the zoning <br />ordinance. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed restaurant/sports <br />barlbilliard parlor is compatible with the existing office uses located in the <br />Stoneridge Corporate Center and would work well with those uses. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Secti on 1. <br /> <br />Approves Case UP-96-37, the application of Masse's Billiards, Sports, Bar & Grill <br />for a conditional use permit to allow the establishment of a sports bar and billiard <br />parlor located at 6180 Embarcadero Court, Suite A subject to the conditions <br />shown in Exhibit "B," attached hereto and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br /> <br />THIS RESOLUTION ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON ON THE 24TH DAY OF JULY 1996 BY THE FOLLOWING VOTE: <br />
