<br />Resolution No. PC-96-52 <br />Page 7 <br /> <br />EXHIBIT "B" <br />PUD-96-09 <br />PLANNING COMMISSION <br />CONDITIONS OF APPROVAL <br /> <br />1. The subdivision and construction of this development shall substantially conform to the de- <br />velopment plans, Exhibit "A", dated "Received June 7, 1996" on file with the Planning De- <br />partment, except as modified by the following conditions. Minor changes to the plans may <br />be allowed subject to the approval of the Planning Director if found to be in substantial <br />conformance to the approved exhibits. <br /> <br />2. This development plan shall be of no further validity and the owner/developer shall be re- <br />quired to submit the same or new development plan for City approval prior to development <br />ofthe site in the event that any of the following occur: <br /> <br />a. The applicant fails to receive growth management approval within two (2) years of <br />PUD approval, <br /> <br />b. Subsequent to such approval, the owner/developer allows the growth management ap- <br />proval to lapse, or <br /> <br />c. The City of Pleasanton does not accept a recreation easement from the Alameda <br />County Water Quality and Flood Control District Zone 7 from the top-of-bank of the <br />Arroyo Del Valle. <br /> <br />3. This PUD shall be subject to the uses of the R-I-6,500 zoning district, except that: <br /> <br />a. No secondary dwelling units are permitted. <br /> <br />b. No addition is permitted to an existing building, except for an attached or detached <br />patio cover or trellis. <br /> <br />c. Attached or detached patio covers and trellises may be located within 3' 0" of the rear <br />or side property line, except for the lots facing Del Valle Parkway where the mini- <br />mum setback from the property line shall be 5' 0". Attached or detached patio covers <br />and trellises shall have a maximum height of 9' 0", shall be of wood construction, and <br />shall match the design of the primary structures. <br /> <br />4. Prior to issuance of a building and/or foundation permit, the developer shall pay any and all <br />fees to which the subject project may be subject. The type and amount of the fees shall be <br />those in effect at the time the building/foundation permit is issued. <br />
