Development shall be substantially as shown on the development plans, Exhibit "A", <br />dated "Received April 26, 1996" and "Received May 31,1996" on file with the Planning <br />Department, except as modified by the following conditions. Minor changes to the plans <br />may be allowed subject to the approval ofthe Planning Director iffound to be in <br />substantial conformance to the approved exhibits. A six-foot high berm shall be <br />permitted along the new Vineyard Avenue alignment. <br /> <br />2. Approval of this use permit for stockpiling fill material on the site and relocating existing <br />structures does not entitle the applicant to any future development of the site beyond or in <br />addition to that accorded with the zoning and General Plan land use designations. <br />Approval of the use permit in no way implies any approval of a development plan, a <br />certain number of lots, or permanent retention of any existing structures. Nor does it <br />guarantee the applicant a particular grading plan, pad elevations, or berm elevations for <br />any future development plan submitted for review. <br /> <br />3. Any future development plan for the site shall be reviewed on its own merits and fill <br />material placed on this site through use permit approval may be required to be regraded, <br />recontoured, or even removed if deemed necessary to achieve the best development plan <br />possible. Similarly, the relocation of the existing home and replacement of the trailer <br />does not imply that these structures would be approved under any future development <br />plan. The applicant may apply to retain these structures at the time a PUD for the site is <br />submitted but the structures shall be reviewed in relation to the overall development plan. <br /> <br />4. No fill may be placed within ten feet of the trunks of existing trees. Prior to issuance of a <br />grading permit, construction fencing shall be erected at a minimum ten foot diameter <br />around every tree. All tree protection fencing shall remain in place until all grading and <br />construction/relocation of structures is completed. <br /> <br />5. Prior to the issuance of grading permits, the grading plan shall be modified to reflect the <br />following: <br /> <br />a. No fill slopes shall exceed a 3:1 maximum slope. <br /> <br />b. The driveway location shall be indicated on the final grading plan and any grading <br />necessary to accommodate it shall be included as part of the final grading plan. No <br />driveway slopes shall exceed 15%. <br /> <br />6. Prior to the issuance of any grading or on-site permit the applicant shall indicate how the <br />relocated house will be serviced with sewer and water. The applicant may continue to <br />utilize any existing wells or septic systems if approved by the County of Alameda <br />Health Services Department, but once a development plan is approved, all structures <br />on-site must make use of City water, sewer, and storm drain utilities. <br />
