The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />The conditions of approval and the applicant's preliminary grading plan <br />and relocation plan will ensure that the site remains within the standards of <br />all applicable City codes. Final grading plans will be subject to the review <br />and approval of the City Engineer. The filled areas will be subject to the <br />same types of grading, drainage, hydroseeding, and other "standard" <br />requirements for grading and construction as are all other sites in the City. <br />Building permits and/or review of plans are required for the relocation of <br />the home and trailer which will ensure that all Uniform Building Codes <br />are met for safe construction practices. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of this chapter. <br /> <br />The City's Municipal Code permits the use of properties which are <br />designated with a PUD zoning but which have no development plan with <br />approval of a conditional use permit. The site currently holds a zoning <br />designation ofPUD--Low Density Residential. The placement offill on <br />the site complies with the Municipal Code and relocating one home and a <br />storage trailer is not in conflict with the zoning for the property or the <br />Municipal Code. Locating fill on the site, relocating existing structures, <br />and maintaining the same types of uses and levels of use do not and will <br />not preclude the use of this property for future development in accordance <br />with the PUD zoning and applicable provisions of the Municipal Code. <br /> <br />WHEREAS, projects ofthis nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed conditional use is <br />appropriate for the site <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section I. <br /> <br />Approves Case UP-96-22, the application of Ken Gooch for a conditional use <br />permit to place 10,000 cubic yards of fill on an existing property which is zoned <br />PUD, but which has no development plan, and relocate an existing small house <br />and replace an existing storage trailer with a larger storage trailer, located at 2530 <br />Vineyard Avenue, subject to the conditions shown in Exhibit "B," attached hereto <br />and made part of this case by reference. <br />
