PC-96-46 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF KEN GOOCH FOR A <br />CONDITIONAL USE PERMIT, AS FILED UNDER CASE UP-96-22 <br /> <br />WHEREAS, Ken Gooch has applied for a conditional use permit to place 10,000 cubic yards of <br />fill on an existing property which is zoned PUD, but which has no development <br />plan, and relocate an existing small house and replace an existing storage trailer <br />with a larger storage trailer, located at 2530 Vineyard A venue; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - LDR (Low Density <br />Residential) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of June 26, 1996, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The proposed filling of the site and relocation of existing structures is in <br />accordance with the zoning ordinance which requires approval of a use <br />permit for temporary uses on sites which are designated with a PUD <br />zoning but have no approved development plan. The site is zoned <br />PUD--Low Density Residential. The placement of fill and relocation of <br />structures on the site would not interfere with any future use of the site, as <br />approval of the use permit does not imply approval of any future <br />development plan for the site or approval for the retention of these <br />structures in perpetuity. The addition of fill to the site and relocation of <br />the house and storage trailer do not intensify the existing use of the site as <br />a single-family residential property, nor do they interfere with surrounding <br />land uses, zonings, or General Plan designations. The proposed conditions <br />of approval for the project give the City appropriate controls to ensure that <br />the fill and relocation are carried out in accordance with all rules and <br />regulations of the City and that the use does not have any negative impacts <br />on surrounding properties. <br />
