ORDINANCE NO. 2302 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING A MAJOR MODIFICATION TO THE APPROVED DEVELOPMENT <br /> PLAN FOR PUD-54, TO INSTALL AN ELECTRIC GATE AT THE ENTRANCE TO <br /> WINDING OAKS DRIVE, AS FILED UNDER CASE NO. PUD-54-01M <br /> WHEREAS, on April 25, 2025. Tony and Linda Brunetti on behalf of Winding Oaks Drive <br /> residents ("Applicant") applied for a PUD Major Modification approval under Case No. PUD-54- <br /> 01 M to install a gate at the entrance to Winding Oaks Drive ("Property); and <br /> WHEREAS, the Property is designated Low Density Residential and Open Space in the <br /> General Plan; and <br /> WHEREAS. the Property is located within the PUD-54 area, following the development <br /> plan approved by City Council Ordinance 1938; and <br /> WHEREAS, on October 22, 2025, with a 5-0 vote, the Planning Commission made the <br /> findings, and recommended to the Pleasanton City Council PUD-54-01M be approved; and <br /> WHEREAS. on December 2, 2025, the Pleasanton City Council held a duly noticed public <br /> hearing on this application and considered all public testimony. agenda reports, and related <br /> materials, and the recommendations of City staff and the Planning Commission. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY <br /> ORDAIN AS FOLLOWS: <br /> SECTION 1. Prior to taking action on the Project, and at a properly noticed public meeting, <br /> the City Council reviewed written and oral staff reports, conducted a public hearing on the Project <br /> and took testimony, and received into the record all pertinent documents related to the Project <br /> (collectively. the "Record Evidence"). The City Council's determination is based on the Record <br /> Evidence, which is incorporated into this Ordinance by reference. <br /> SECTION 2. The project is within the scope of the Vineyard Avenue Corridor Specific Plan <br /> Environmental Impact Report (EIR). No additional environmental review is required under the <br /> California Environmental Quality Act (CEQA) Section 15162 because no substantial changes to <br /> the PUD are proposed, no substantial changes have occurred with respect to the circumstances <br /> under which the project is undertaken, and no new information of substantial importance shows <br /> that the project will have one or more significant effects not discussed in the previous EIR. <br /> SECTION 3. With respect to the Planned Unit Development application, PUD-54-01 M, <br /> The City Council makes the following findings and determinations with respect to each of the <br /> considerations for approval of a PUD Development Plan as required by Section 18.68.110 of the <br /> Pleasanton Municipal Code (PMC): <br /> 1. Whether the proposed development plan is in the best interest of the public <br /> health, safety, and general welfare. <br /> The City Council finds that the proposed project, as conditioned, meets all applicable <br /> City standards concerning public health, safety, and welfare.
