<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-96-39 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF CONNIE HARRIS FOR A <br />CONDITIONAL USE PERMIT, AS FILED UNDER CASE UP-96-24 <br /> <br />WHEREAS, Connie Harris has applied for a non-exempt home occupation use permit to <br />operate an in-home electrolysis business located at 4787 Canary Drive; and <br /> <br />WHEREAS, zoning for the property is R-I-6,500 (Single-Family Residential) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of June 12, 1996, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />Chapters 18.32 and 18.36 permit home occupations to be conducted in <br />residences in the R-l and RM zoning districts, in accordance with Chapter <br />18.104 (Home Occupations). Some of the objectives of the R-l and RM <br />districts are to protect residential properties from the hazards, noise, and <br />congestion created by commercial and industrial traffic, and to protect <br />properties from noise, illumination, unsightliness, odors, dust, dirt and <br />other objectionable influences and hazards. <br /> <br />The objective of Chapter 18.1 04 is to permit certain home occupations <br />which traditionally take place in residences and which do not create the <br />potential for changing the residential character of a neighborhood. The <br />home electrolysis service will be inoffensive and unnoticeable from the <br />exterior of the home, and the limited amount of clients will not create <br />traffic, parking or noise impacts to the neighborhood. Furthermore, the <br />Commission has previously determined that this type of business is <br />acceptable in a residential neighborhood, at least on a temporary basis. <br /> <br />B. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br />
