<br />Resolution No. PC-96-36 <br />Page 3 <br /> <br />EXHIBIT "B" <br />Conditions of Approval <br />Case UP-96-15 <br /> <br />1. That all improvements shall substantially conform to plans, Exhibit "A", dated "Received <br />May 10, 1996", on file with the Planning Department, except as modified by the <br />following conditions. <br /> <br />2. That the applicant obtain and pay for all the necessary City permits for the construction of <br />the secondary unit. <br /> <br />3. Only one residential unit on the subject property may be rented. The other unit shall be <br />owner-occupied. The owner-occupier must be signatory to any lease agreement. With <br />regards to the secondary unit, the unit shall be occupied by no more than two adults, <br />although there shall be no limit on the number of children. The applicant shall prepare a <br />deed restriction to this effect and shall submit it to the City Attorney for review and <br />approval prior to recordation. The recordation shall be accomplished prior to occupancy <br />ofthe secondary unit. <br /> <br />4. In no case shall the secondary unit be sold, subdivided or held under different legal <br />ownership from the primary residence. A deed restriction shall be recorded to this effect. <br />The applicant shall prepare the restriction and shall submit it to the City Attorney for <br />review and approval prior to recordation. The recordation shall be accomplished prior to <br />occupancy of the secondary unit. <br /> <br />5. The applicant shall work with staff to locate a parking space on-site for the exclusive use <br />of the occupant(s) of the secondary unit. This space may be uncovered; however, if such <br />a location is unfeasible, the applicant shall provide one of the garage spaces for the <br />secondary unit. A deed restriction shall be recorded indicating the location of the <br />secondary unit parking space and stating that this space shall be made available at all <br />times to the occupant of the secondary dwelling. The applicant shall prepare the <br />restriction and shall submit it to the City Attorney for review and approval prior to <br />recordation. The recordation shall be accomplished prior to occupancy of the secondary <br />unit. <br /> <br />6. The address of the secondary unit shall be posted to the satisfaction of the Fire Marshall. <br />The method and design of this posting shall be shown on the building permit plans. <br />The applicant shall post address numerals on the front of the building so as to be plainly <br />visible during both daylight and night time hours and clearly indicating that two separate <br />units exist on the parcel. The applicant shall obtain the new street address for the <br />secondary unit from the Planning Department. <br /> <br />7. Prior to issuance of a building permit, the applicant shall pay all applicable Zone 7 and <br />City connection fees and water meter cost for any water meters. In addition, the applicant <br />shall pay any applicable DSRSD sewer permit fees. <br />
