<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-96-36 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF NEIL AND PATRICIA <br />NELSON FOR A CONDITIONAL USE PERMIT, AS FILED UNDER CASE <br />UP-96-15 <br /> <br />WHEREAS, Neil and Patricia Nelson have applied for a conditional use permit to establish a <br />secondary unit within a proposed single-family home at 5206 Foothill Road; and <br /> <br />WHEREAS, zoning for the property is R-I-40,000 (Single-Family Residential - 40,000 square <br />foot minimum lot size) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of May 22,1996, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The request to establish a secondary unit within the existing residence conforms <br />with the objectives and purposes of the zoning ordinance. A secondary unit is <br />considered to be a single family use. The proposal would maintain the existing <br />single-family character because the secondary unit would be completely <br />integrated within the structure, and the secondary unit constitutes less than 23% of <br />the existing living area. In addition, a recommended condition of approval <br />requires that either the primary residence or the secondary unit be owner-occupied <br />and that a maximum of two be adults be allowed to reside in the secondary unit. <br /> <br />B. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />Due to the size limitation of the secondary unit, the traffic generation would be <br />less than that of a single-family residence. As a recommended condition of <br />approval, one of the three spaces in the garage would be kept available for the <br />occupants of the secondary unit. <br />
