The proposed location ofthe conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. Given the proposed hours of operation, the proposed use will not impact surrounding uses. Other church, day care, and dance studio uses within the business park have been conditionally approved by the Commission and have not caused any reported problems. The proposed use will be required to comply with applicable building and fire codes. C. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance. The site's PUD zoning permits the establishment of recreational facilities, non-commercial clubs, and trade schools. The proposed theatre complies with all relevant sections of the zoning ordinance. Granting a conditional use permit to the Pleasanton Playhouse to include theatre productions is consistent with the City's ability to regulate zoning as listed in Municipal Code Section 18.124 "Conditional Uses." WHEREAS, projects of this nature are categorically exempt from the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, the Planning Commission determined that the proposed use, as conditioned, will be compatible with the surrounding uses and properties. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section I. Approves Case UP-96-23, the application of Renee Lewis (Pleasanton Playhouse) for a conditional use permit to expand the Pleasanton Playhouse's existing theatre operations by adding 1,792 square feet of floor area in order to construct a stage and seating area for public performances located at 1048 Serpentine Lane, Suite 303 , subject to the conditions shown in Exhibit "B," attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
