The proposed location ofthe conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />Given the proposed hours of operation, the proposed use will not impact <br />surrounding uses. Other church, day care, and dance studio uses within the <br />business park have been conditionally approved by the Commission and have not <br />caused any reported problems. The proposed use will be required to comply with <br />applicable building and fire codes. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the Zoning Ordinance. <br /> <br />The site's PUD zoning permits the establishment of recreational facilities, <br />non-commercial clubs, and trade schools. The proposed theatre complies with all <br />relevant sections of the zoning ordinance. Granting a conditional use permit to <br />the Pleasanton Playhouse to include theatre productions is consistent with the <br />City's ability to regulate zoning as listed in Municipal Code Section 18.124 <br />"Conditional Uses." <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed use, as conditioned, will <br />be compatible with the surrounding uses and properties. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section I. <br /> <br />Approves Case UP-96-23, the application of Renee Lewis (Pleasanton Playhouse) <br />for a conditional use permit to expand the Pleasanton Playhouse's existing theatre <br />operations by adding 1,792 square feet of floor area in order to construct a stage <br />and seating area for public performances located at 1048 Serpentine Lane, <br />Suite 303 , subject to the conditions shown in Exhibit "B," attached hereto and <br />made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
