<br />Resolution No. PC-96-28 <br />Page 4 <br /> <br />5. The property owner or its successors in interest (owner) shall enter into a deferred <br />improvement agreement with the City of Pleasant on (City) to provide that: <br /> <br />a. the owner shall either not protest the establishment of an assessment district, or shall <br />affirmatively vote for the creation of the district or other mechanism to pay for the <br />public park or recreation facilities' needs of the employees working in the <br />employment sectors of Pleasanton, depending on the manner of creation of the <br />funding mechanism; <br /> <br />b. the owner retains the right to protest that the allocation of costs among various <br />properties is inequitable under the above-mentioned funding mechanisms; and <br /> <br />c. in the event the assessment mechanism appears to impose economically infeasible <br />levels of costs upon the site, the City agrees to explore alternative financing methods. <br /> <br />6. All masonry pilasters shall be treated with a top cap treatment. This detail shall be shown <br />on the final building plan set for review and approval by the Planning Director before <br />issuance of a building permit. <br /> <br />7. Landscape end caps to be located in the parking area on the north side of the proposed <br />structure shall have a net minimum width of five feet (5' on). It is noted that implementing <br />this requirement will result in the loss of approximately four (4) parking spaces. This detail <br />shall be shown on the final site, grading, and landscape plans for review and approval by <br />the Planning Director before issuance of a building permit. <br /> <br />8. If the subject property is divided into two separate parcels, cross access and parking <br />easements shall be recorded on both parcels. <br /> <br />9. With construction of the proposed office building, the applicant shall install a concrete <br />"landing" and sidewalk along the north side of the new driveway entrance opposite Johnson <br />Drive. The "landing" would be located directly opposite the sidewalk located on the <br />opposite side of Franklin Drive. <br /> <br />10. With construction of the building pad, if developed with a pedestrian-intensive use, e.g., <br />restaurant, retail, etc., the applicant shall install a sidewalk in the PSE along Franklin Drive <br />from Stoneridge Drive to the south side of the new driveway entrance opposite Johnson <br />Drive. The final location of the sidewalk shall be determined by the Planning Director and <br />the City Engineer. <br /> <br />~--,."--'--"'--------- <br />
