The proposed location of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public health, <br />safety, or welfare, or materially injurious to the properties or improvements in the <br />vicinity . <br /> <br />The proposal to extend the health club facility's hours of operation is not <br />anticipated to have an adverse impact on any of the surrounding properties due to <br />the proposed conditions of approval which would serve as performance standards. <br />Adequate parking is available to prevent encroachment onto neighboring <br />properties, and conditions have been added to prevent adverse impacts from noise <br />and automobile headlight intrusion. The significant issues related to the health, <br />safety, or welfare of the general public have been identified through previous use <br />permit processes. The conditions of project approval will ensure that the proposal <br />to extend the health club facility's hours of operation remain within the standards <br />of all applicable City codes. <br /> <br />C. The proposed conditional use will comply with each of the applicable provisions <br />of this chapter. <br /> <br />The proposed use complies with all relevant sections of the zoning ordinance. <br />Granting a conditional use permit to H.E.C. Investments, Inc. to extend the health <br />club facility's hours of operation is consistent with the City's ability to regulate <br />zoning as listed in Municipal Code Section 18.124 "Conditional Uses." <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposal to extend the health club <br />facility's hours of operation would not significantly alter the operation ofthe <br />business and would not have any adverse impacts on the surrounding uses. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section] <br /> <br />Approves Case UP-95-81, the application ofH.E.C. Investments, Inc. to amend <br />an existing conditional use permit to extend the hours of operation for an existing <br />health club facility located at 5860 West Las Positas Boulevard, subject to the <br />conditions shown in Exhibit "B," attached hereto and made part of this case by <br />reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
