Resolution No. PC-96-05 Page 4 EXHIBIT "B" UP-95-83 PLANNING COMMISSION CONDITIONS OF APPROVAL I. The proposed use shall conform substantially to the site plan, floor plan, and narrative dated "Received December 21,1995" and the floor plan and narrative dated "Received December 29,1995", Exhibit "A", on file with the Planning Department, except as modified by these conditions. Minor changes to the plans may be allowed subject to the approval of the Planning Director if found to be in substantial conformance with approved exhibits. 2. The hours of operation for the business shall be 10:00 a.m. to 10:00 p.m. Sunday through Thursday and 10:00 a.m. to midnight Friday and Saturday. Additional hours may be allowed subject to the approval ofthe Planning Director. 3. No signage is approved as part of this application. Any proposed signage shall be reviewed and approved under separate application. 4. This use permit allows up to 12 computer work stations and 3 employees. If the applicants wish to expand their business to more than 12 work stations and 3 employees, they shall contact the Planning Department for review the Comet CyberCentre operation. If it can be determined that the business has operated as anticipated with no negative impacts on the shopping center and the surrounding uses and that sufficient parking is available for the expansion, the Planning Director shall be able to approve an expansion to as many as 20 workstations and 4 employees. 5. If operation of this use results in conflicts pertaining to parking, noise, traffic, or other impacts, at the discretion of the Planning Director, this use permit may be submitted to the Planning Commission for subsequent review at a public hearing. If necessary, the Commission may modify or add conditions of approval to mitigate such impact, or may revoke the use permit. 6. The applicant shall contact the Building and Fire Departments to determine all applicable code requirements. The applicant shall obtain all building and other applicable City permits for the use and structure prior to occupancy. The structure must be made to conform to all applicable occupancy requirements, codes, and ordinances of the City including handicapped access requirements. 7. The business staff shall regularly monitor the programs being used by the patrons and shall not permit the use of adult-oriented material. The business shall use software (e.g. "SurfWatch") in order to help prevent access to adult material. No tenant improvements are allowed which would create private booths around the work stations and preventdirect line of sight viewing of the activities of the patrons by the business staff.
