<br />Resolution No. PC-96-05 <br />Page 4 <br /> <br />EXHIBIT "B" <br />UP-95-83 <br />PLANNING COMMISSION <br />CONDITIONS OF APPROVAL <br /> <br />I. The proposed use shall conform substantially to the site plan, floor plan, and narrative <br />dated "Received December 21,1995" and the floor plan and narrative dated "Received <br />December 29,1995", Exhibit "A", on file with the Planning Department, except as <br />modified by these conditions. Minor changes to the plans may be allowed subject to the <br />approval of the Planning Director if found to be in substantial conformance with <br />approved exhibits. <br /> <br />2. The hours of operation for the business shall be 10:00 a.m. to 10:00 p.m. Sunday through <br />Thursday and 10:00 a.m. to midnight Friday and Saturday. Additional hours may be <br />allowed subject to the approval ofthe Planning Director. <br /> <br />3. No signage is approved as part of this application. Any proposed signage shall be <br />reviewed and approved under separate application. <br /> <br />4. This use permit allows up to 12 computer work stations and 3 employees. If the <br />applicants wish to expand their business to more than 12 work stations and 3 employees, <br />they shall contact the Planning Department for review the Comet CyberCentre operation. <br />If it can be determined that the business has operated as anticipated with no negative <br />impacts on the shopping center and the surrounding uses and that sufficient parking is <br />available for the expansion, the Planning Director shall be able to approve an expansion <br />to as many as 20 workstations and 4 employees. <br /> <br />5. If operation of this use results in conflicts pertaining to parking, noise, traffic, or other <br />impacts, at the discretion of the Planning Director, this use permit may be submitted to <br />the Planning Commission for subsequent review at a public hearing. If necessary, the <br />Commission may modify or add conditions of approval to mitigate such impact, or may <br />revoke the use permit. <br /> <br />6. The applicant shall contact the Building and Fire Departments to determine all applicable <br />code requirements. The applicant shall obtain all building and other applicable City <br />permits for the use and structure prior to occupancy. The structure must be made to <br />conform to all applicable occupancy requirements, codes, and ordinances of the City <br />including handicapped access requirements. <br /> <br />7. The business staff shall regularly monitor the programs being used by the patrons and <br />shall not permit the use of adult-oriented material. The business shall use software (e.g. <br />"SurfWatch") in order to help prevent access to adult material. No tenant improvements <br />are allowed which would create private booths around the work stations and prevent direct line of sight viewing of the activities of the patrons by the business staff. <br />
