The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public heath, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />The proposed use would have little impact on the existing uses in the <br />vicinity because, as stated above, the proposed business, which would <br />operate entirely indoors, is physically constrained by a small structure and <br />would operate at a small scale. The proposed business would generate a <br />relatively small number of vehicle trips and require a low number of <br />employees (one). In order to insure safe vehicle circulation, the proposed <br />business would not be allowed to operate when the gate behind the subject <br />building is closed. The proposed business would be required to comply <br />with the Uniform Building Code and the Pleasanton Fire Code, and would <br />be required to secure the appropriate City permits prior to commencement <br />of the use. Moreover, a condition of approval requires the applicant to <br />mitigate any future nuisances which may occur as a result of the proposed <br />use. <br /> <br />C. The proposed conditional use will comply with each ofthe applicable <br />provisions of the zoning ordinance. <br /> <br />Chapter 18.124 of the Zoning Ordinance states that, because of their <br />unusual characteristics, conditional uses require special consideration so <br />that they may be located properly with respect to their effects on <br />surrounding properties. The recommended conditions of approval will <br />help to integrate the proposed use without detrimentally affecting the <br />surrounding properties of the City in general. As conditioned, the <br />proposed use will comply with all provisions and requirements of the <br />City's zoning ordinance. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed use, as conditioned, will <br />be compatible with the surrounding uses and properties. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-95-75, the application of Sylvia D'Angelo for a conditional <br />use permit to operate a second had store at 3876 Old Santa Rita Road, subject to <br />the conditions shown in Exhibit "B," attached hereto and made part of this case by <br />reference. <br />
