The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />The conditions of approval will ensure that the site remains within the <br />standards of all applicable City codes. The applicant will be responsible for <br />implementing all necessary erosion control measures. The proposed <br />grading is necessary to ensure that the production of methane gas from the <br />refuse area is adequately controlled and surface migration is minimized. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br /> <br />The City's Municipal Code permits the use of properties which are <br />designated with a PUD zoning but which have no development plan with <br />approval of a conditional use permit. The site currently holds a zoning <br />designation ofPUD-RDR. The placement ofthe clay layer on the site <br />complies with the Municipal Code and is not in conflict with the zoning for <br />the property or the Municipal Code. The installation of the clay layer will <br />not preclude the use of this property for future development in accordance <br />with the PUD zoning and applicable provisions of the Municipal Code <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project. <br /> <br />WHEREAS, the Planning Commission determined that the proposed use permit, as conditioned, <br />is appropriate for the site. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-97-72, the application of Mike Dominisse for a conditional use <br />permit for interim grading to install a clay cap over a portion of the site which <br />contains buried landfill located at 2500 Vineyard Avenue, generally the <br />southernmost terminus of Pietro nave Lane, subject to the conditions shown in <br />Exhibit "B," attached hereto and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption unless <br />appealed prior to that time. <br />
