<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-97-83 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF MIKE DOMINISSE, AS <br />FILED UNDER CASE UP-97-72 <br /> <br />WHEREAS, Mike Dominisse has applied for a conditional use permit for interim grading to <br />install a clay cap over a portion of the site which contains buried landfill located at <br />2500 Vineyard Avenue, generally the southernmost terminus of Pietro nave Lane; <br />and <br /> <br />WHEREAS, zoning for the property is POO (Planned Unit Development) - RDR (Rural <br />Density Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of October 8, 1997, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the City <br />staff concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The proposed installation of the clay layer is in accordance with the zoning <br />ordinance which requires approval of a use permit for grading prior to <br />PUD development plan approval. The placement of the clay layer will <br />involve a minor amount of grading and would not interfere with any future <br />use of the site as approval of the use permit does not imply approval of any <br />future development plan for the site. The grading does not intensifY the <br />existing use of the site as a vacant single-family residential property, nor <br />does it interfere with surrounding land uses, zoning designations, or <br />General Plan designations. The proposed conditions of approval for the <br />project give the City appropriate controls to ensure that the grading is <br />carried out in accordance with all rules and regulations of the City and that <br />the use does not have any negative impacts on surrounding properties. <br />
