PLANNING COMMISSION CITY OF PLEASANTON

ALAMEDA COUNTY, CALIFORNIA

RESOLUTION NO. PC-97-81

RESOLUTION APPROVING THE APPLICATION OF ROBERT SYMONS ASSOCIATES,
AS FILED UNDER CASE UP-97-65

WHEREAS, Robert Symons Associates has applied for a conditional use permit to construct an
approximately 750 square foot second unit within a new 7,600 square foot
single-family home located at 1441 Forenza Court (Ruby Hill); and

WHEREAS, zoning for the property is PUD (planned Unit Development) - NOS/LDR
(Agriculture/Open Space, Low Density Residential) District; and

WHEREAS, at its duly noticed public hearing of October 8, 1997, the Planning Commission
considered all public testimony, relevant exhibits, and recommendations of the City
staff concerning this application; and

WHEREAS, the Planning Commission made the following findings:

A. The proposed location of the conditional use is in accordance with the
objectives of the zoning ordinance and the purpose of the district in which the site
is located.

The request to establish a second unit within the existing residence conforms with
the objectives and purposes of the zoning ordinance and the purpose of the Ruby
Hill PUD. State law considers second units as a single-family use. The proposal
will maintain the existing single-family character of the Ruby Hill development
because the unit is designed as part of the home, indistinguishable from the exterior
as a second unit.

B. The proposed location of the conditional use and the conditions under
which it would be operated or maintained will not be detrimental to the public
health, safety, or welfare, or materially injurious to the properties or improvements
in the vicinity.

Due to the limited size of the second unit, and its proposed use, traffic generated
by use of the unit should not be significantly greater than that of a single-family
residence.

C. The proposed conditional use will comply with each of the applicable
provisions of the zoning ordinance.
