<br />Resolution No. PC-97-76 <br />Page 3 <br /> <br />EXHffiIT B <br />Conditions of Approval <br />Case UP-97-55 <br />Mary Harpster <br /> <br />1. The proposed use shall conform substantially to the written narrative, Exhibit" A", dated <br />"September 4, 1997" and site plan, Exhibit "A", dated "August 1, 1997", on file with the <br />Planning Department, except as modified by these conditions. <br /> <br />2. If operation of the proposed use results in conflicts pertaining to parking, noise, traffic, or <br />other impacts, at the discretion of the Planning Director, this use permit may be submitted <br />to the Planning Commission for subsequent review at a public hearing. If necessary, the <br />Commission may modifY or add conditions of approval to mitigate such impact, or may <br />revoke the use permit. <br /> <br />3. This use permit shall be reviewed one year from the date of approval, at which time <br />neighbors within 300 feet of 1045 Riesling Drive will be noticed of a 15 day comment <br />period. If the neighbors, applicant, or City staff have comments or concerns with the <br />application of this home occupation, the Planning Director may add or modifY the <br />conditions of approval, or the Director may refer the matter to the Planning Commission if <br />deemed necessary. <br /> <br />4. From April 1 through June 30 and from September 1 through October 31, hours of <br />operation are limited to 3:30p.m. to 6:00p.m. on Monday, Tuesday, Wednesday, and <br />Thursday, and from 1O:00a.m. to 1 :30p.m. on Saturday. No swim lessons are permitted <br />on Friday and Sunday. <br /> <br />5. From July 1 through August 31, hours of operation are limited to 9:00a.m. to 1 :30p.m. on <br />Monday and Wednesday, from 10:00a.m. to l:30p.m. on Saturday, and from 3:30p.m. to <br />6:00p.m. on Tuesday. No swimming lessons are permitted on Thursday, Friday, and <br />Sunday. <br /> <br />6. The first swim lesson taught between 9:00a.m. and 10:00a.m. shall be an individual lesson <br />with a maximum of one student at anyone time. <br /> <br />7. All lessons between 5:00p.m. and 6:00p.m. shall be limited to one vehicle. <br /> <br />8. From 10:00a.m. to 5:00p.m. a maximum offour students may be taught at anyone time. <br /> <br />9. A fifteen minute break, in which no students are taught, shall be held in between each <br />swim lesson between 9:00a.m. and 5:00p.m. <br /> <br />--------------...-.-------...----- <br />
