PC-97-73 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF GTE MOBILNET/ <br />MATTHEWS LAND COMPANY FOR A CONDITIONAL USE PERMIT AND <br />DESIGN REVIEW APPROVAL, AS FILED UNDER CASE UP-97-54/Z-97-203 <br /> <br />WHEREAS, GTE Mobilnet/Matthews Land Company has applied for a conditional use permit <br />and design review approval to allow the construction and operation of a cellular <br />communications facility involving the addition of a 9' 0" tall transmission! receiving <br />antenna extension to the existing Cellular One monopole, raising the monopole's <br />height from 75' 0" to 84' 0", and construction of an approximately 113 sq. ft. <br />unmanned equipment building, with the monopole extension to be located at 3830 <br />Old Santa Rita Road and the equipment building to be located at 3876 Old Santa <br />Rita Road; and <br /> <br />WHEREAS, zoning for the property is C-S (Commercial Service) District and PUD (Planned <br />Unit Development) - C-S (Commercial-Service) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of August 27, 1997, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations ofthe City <br />staff concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location ofthe conditional use is in accordance with the objectives <br />of the zoning ordinance and the purpose ofthe district in which the site is located. <br /> <br />The monopole site is zoned C-S Service Commercial and the equipment building <br />site is zoned PUD _ C-S allowing the permitted and conditional uses of the C-S <br />district. Public utility installations including cellular telecommunication <br />monopoles, antennas, and equipment buildings are conditionally allowed uses in <br />these zoning districts. In the context of the surrounding area, characterized by <br />other conditionally allowed C-S type uses, e.g., automotive sales and storage, <br />wrecking yards, automotive repair, etc., cellular communication facilities can be <br />found to be consistent with these zoning districts. <br /> <br />B. The proposed location ofthe conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public heath, safety, <br />or welfare, or materially injurious to the properties or improvements in the vicinity. <br /> <br />----.-.-....-.---..------ <br />
