The developer does hereby acknowledge that the City is not guaranteeing that the existing <br />LOS standards will be maintained in perpetuity and that no guarantee is made that the City <br />will be responsible for keeping intersections at LOS D or better. <br /> <br />9. The developer shall implement a proactive Transportation Systems Management program <br />or other measures which will positively mitigate the project's otherwise anticipated traffic <br />impacts. <br /> <br />10. Prior to building permit issuance, a lot line adjustment shall be processed to merge the two <br />properties to the satisfaction of the Planning Director. <br /> <br />11. The applicant shall effectively screen from view all ducts, meters, air conditioning <br />equipment, and any other mechanical equipment, whether on the structure, on the ground, <br />or on the roof, with materials architecturally compatible with the main structure. <br />Screening details shall be shown on the plans submitted for issuance of building permits, <br />the adequacy of which shall be determined by the Planning Director. All required <br />screening shall be provided prior to building occupancy. <br /> <br />12. All mechanical equipment shall be constructed in such a manner that noise emanating from <br />it will not be perceptible beyond the property plane of the subject property in a normal <br />environment for that zoning district. <br /> <br />13. The applicant shall submit a final lighting plan for the building and the site for the review <br />and approval ofthe Planning Director prior to issuance of building permits. <br /> <br />14. Trash containers shall be stored within the enclosure at all times, except when being <br />unloaded. <br /> <br />15. All parking spaces shall be striped. Wheel stops shall be provided unless the spaces are <br />fronted by concrete curbs, in which case sufficient areas shall be provided beyond the ends <br />of all parking spaces to accommodate the overhang of automobiles. <br /> <br />16. All utilities required to serve any existing or proposed development on-site shall be <br />installed underground, unless otherwise determined by the City Engineer. <br /> <br />17. The applicant shall enter into an agreement with the City, approved by the City Attorney, <br />which guarantees that all landscaping included in this project will be maintained at all times <br />in a manner consistent with the approved landscape plan for this development prior to <br />building occupancy.
