The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained win not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />The conditions of approval and the applicant's preliminary grading plan wi\1 ensure <br />that the site remains within the standards of all applicable City codes. Final <br />grading plans will be subject to the review and approval of the City Engineer. The <br />fined areas will be subject to the same types of grading, drainage, hydroseeding, <br />dust control, and other "standard" requirements for grading and construction as <br />are all other sites in the City. The fill sites have been located as far as feasibly <br />possible from property lines shared with residential neighbors to reduce visual and <br />drainage impacts ofthe fin material. Existing drainage patterns along and near <br />these shared property lines wi\1 not be affected by the fin material. Fi\1 wi\1 be <br />properly located to ensure that existing catch basins, detention areas, vent pipes, <br />and monitoring wens win remain unaffected. <br /> <br />C. The proposed conditional use wi\1 comply with each ofthe applicable <br />provisions of the zoning ordinance. <br /> <br />The City's Municipal Code permits the use of properties which are designated with <br />a PUD zoning but which have no development plan with approval of a conditional <br />use permit. The site currently holds a zoning designation ofPUD--Rural Density <br />Residential/Low Density Residential. The placement offill on the site complies <br />with the Municipal Code and is not in conflict with the zoning for the property or <br />the Municipal Code. Locating fill on the site and maintaining the same types of <br />anowed uses and intensity of uses does not and wi\1 not preclude the use of this <br />property for future development in accordance with the PUD zoning and <br />applicable provisions of the Municipal Code. <br /> <br />WHEREAS, projects ofthis nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project. <br /> <br />WHEREAS, the Planning Commission determined that the proposal, as conditioned, is <br />appropriate for the site. <br /> <br />-_.~------_.--'-- ---,--'--- <br />
