<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-97-69 <br /> <br />RESOLUTION APPROYING THE APPLICATION OF SIGNATURE PROPERTIES, <br />AS FILED UNDER CASE UP-97-51 <br /> <br />WHEREAS, Signature Properties has applied for a conditional use permit to place surplus fill <br />material generated from the Vineyard S-Curve realignment project on <br />approximately 3.5 acres of a 23-acre site located at 2512 Yineyard Avenue (former <br />Pleasanton Garbage Service landfill site); and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - RDR-LDR (Rural <br />Density ResidentiaIILow Density Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of August 13, 1997, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the City <br />staff concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The proposed filling of portions ofthe site are in accordance with the zoning <br />ordinance, which requires approval of a use permit for temporary uses on sites <br />which are designated with a PUD zoning but have no approved development plan. <br />The site is zoned PUD - Rural Density ResidentialILow Density Residential. The <br />placement of fill on the site would not interfere with any future use of the site as <br />approval of the use permit does not imply approval of any future development for <br />the site. The addition of fill to the site does not intensifY the existing use of the site <br />as a single-family residential property and private dog kennel (and former landfill), <br />nor does it interfere with surrounding land uses, zonings, or General Plan <br />designations. The proposed conditions of approval for the project give the City <br />appropriate controls to ensure that the fill is placed on the site in accordance with <br />all rules and regulations of the City and that the use does not have any negative <br />impacts on surrounding properties. <br />
