<br />Resolution No. PC-97-6l <br />Page 6 <br /> <br />This cash bond or security shall be retained for one year following acceptance of public <br />improvements or completion of construction, whichever is later, and shall be forfeited, if <br />the tree is destroyed or substantially damaged. In accordance with the City's Heritage <br />Tree Ordinance, the City may levy an additional fine based upon the tree's assessed <br />valuation if the tree is destroyed or substantially damaged. <br /> <br />18. In addition to the tree preservation mitigation measures of the EIR, the following tree <br />preservation methods shall be followed. These methods shall include, but not be limited <br />to, the following: <br /> <br />a. No trenching for utilities shall take place within the dripline of the existing <br />sycamore tree. <br /> <br />b. Temporary wire or mesh fencing shall be utilized around the existing sycamore <br />tree. No equipment may be operated within or beneath the dripline of this tree, and no <br />equipment or temporary structures shall be placed within or beneath the dripline of this <br />tree. This fencing must be installed prior to grading and shall remain in place until all <br />grading and all construction activities are completed. Failure to provide the fencing, or <br />removal of the fencing during grading or construction may result in a "stop work" notice. <br /> <br />c. The dripline of the existing sycamore tree shall be field-verified and plotted <br />accuratelv on the final site. landscape. and grading plans. The grading and utility plans <br />may need to be adjusted in accordance with the actual dripline of the tree to ensure that <br />no utilities or construction occurs within the dripline the tree. <br /> <br />d. Ensure that concrete/gunite workers, supply trucks, painters, or concrete/plasterer <br />workers do not store materials or discharge wash water under the dripline of the sycamore <br />tree. No vehicles or construction materials shall be stored under the driplines of any <br />existing on-site trees. <br /> <br />General Planning Conditions <br /> <br />19. The developer is encouraged to work with the City's Civic Arts Commission to provide <br />public art. <br /> <br />20. If archeological materials are uncovered during grading, trenching, or other on-site <br />excavation, all work on site shall be stopped and the City immediately notified. The <br />county coroner and the Native American Heritage Commission shall also be notified and <br />procedures followed as required in Appendix K of the California Environmental Quality <br />Act. A similar note shall appear on the improvement plans. <br /> <br />21. The developer shall submit a final lighting plan for the building and the site for the review <br />and approval of the Planning Director prior to the issuance of building permits. All <br />lighting shall comply with the requirements of the BCP guidelines. <br />
