The proposed location of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public heath, <br />safety, or welfare, or materially injurious to the properties or improvements in the <br />vicinity. <br /> <br />As proposed and conditioned, the use will generate very few vehicle trips, would <br />not generate a significant amount of noise, and will not involve activities such as <br />washing with soap and servicing vehicles. The subject lot will be paved and <br />graded to surface drain towards a storm drain inlet with a oil/water separator in <br />conformance with the City's urban stormwater runoff ordinance. All storm water <br />runoff will be contained entirely on the site and directed to this separator. A new <br />fence will be installed along the southern property line, and all lighting is required <br />to be directed away from the residential uses to the south. The developer is <br />required to secure the appropriate City permits prior to construction ofthe <br />proposed parking area and office building. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br /> <br />Chapter 18.124 of the Zoning Ordinance states that, because of their unusual <br />characteristics, conditional uses require special consideration so that they may be <br />located properly with respect to their effects on surrounding properties. The <br />recommended conditions of approval will help to integrate the proposed use <br />without detrimentally affecting the surrounding properties and the City in general. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements ofthe <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this application; and <br /> <br />WHEREAS, the Planning Commission determined that the proposed use, as conditioned, will <br />be compatible with the surrounding uses and properties, and that the proposed <br />project will enhance the area along Old Santa Rita Road. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-97-08/Z-97-27, the application of Charles Hinkston for 1) a <br />conditional use permit to operate an automobile rental facility, and 2) for design <br />review approval to construct a 480-square foot office building for the automobile <br />rental business located at 3956 Old Santa Rita Road, subject to the conditions <br />shown in Exhibit "B," attached hereto and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
