Attached is a resolut/on initiating the proceedings to annex tiffs properly w the GHAD, <br />inclu~l'mg setting a public hearing on this matter. Notices will al~o ~ sellt to the property <br />owners in The Preserve and informin.~ them of the Board's intent to annex tills territory. <br /> <br />DISCUSSION <br /> <br />The documents submitted satisfy the state law. The property owners have signed the petition <br />and the Plan of Control contains all the necessary elements. The attached resolution will set a <br />public hearing date when the Council will consider, formally, the annexation. The Council <br />will continue to act as the District's Board of Directors. <br /> <br />The territory to be annexed has 43 acres, approximately 7.4 acres of which will be dedicated <br />to the City for park purposes and additional 17.5 acres will be deeded to the Homeowners <br />Association for open space residences. Parcels ~A", ~F", and "G~ the existing Kolb, Miller <br />and Strom residences are not included within the boundary of the GHAD. Not requiring <br />existing residents adjacent to the GHAD to become part of the GHAD is consistent with past <br />policy. <br /> <br />Currently there are 109 properties within the District (102 Laurel Creek Estates plus the 7 <br />~nnexed with Oak Hill Estates), within the Laurel Creek Estates GHAD that are assessed <br />annually for this GHAD. The currem annual assessments are $300/lot. In conformance to <br />Proposition 218, the assessments may be increased by cost of living percentages without <br />submitting the assessments to a vote of those assessed. Staff proposes that the twelve <br />residential lots in Tract 6951 be assessed the same amount as the 109 lots currently assessed, <br />be~innlng upon acceptance of the Public Improvements, the first certificate of occupancy, or <br />two years after the filing of the final map for Kolb Ranch Estates (Tract 6950, whichever <br />occurs first. In addition, the developer of the Kolb Ranch Estates developmem has <br />contributed 12/109 of the total cumulative reserves of the Laurel Creek Estates GHAD <br />(approximately $26,170) to build up a reserve in case significant repairs become necessary. <br /> <br />Kolb Ranch Estates is a 12-lot development on the extension of Kiemetson Drive (which <br />becomes Kolb Ranch Drive within the new development). Kolb Ranch Drive rung parallel <br />with the eastern boundary of the Preserve, intersecting Laurel Creek Drive near Dublin <br />Canyon Road. In their evaluation of the property (Kolb Ranch Estates) proposed to be annexed <br />to the Laurel Creek Estates GHAD, the engineering geologist concluded that there is far less <br />risk of damage to improvements in the area of annexation than to the area currently covered <br />by the existing GHAD. Based on this evaluation, it is not likely that property owners <br />currently paying assessments to the Laurel Creek Estates GHAD will be placed at any greater <br />financial risk by supporting the proposed annexation. <br /> <br />SR:04:136 <br />Page 5 <br /> <br /> <br />
