<br />Resolution No. PC-97-46 <br />Page 2 <br /> <br />The Municipal Code lists some uses as conditional uses so that the Planning <br />Commission may review them and apply certain operational conditions to those <br />uses to ensure that they remain compatible with other permitted uses in the same <br />district and area. The location of this use in a primarily commercial/office area <br />and within the Downtown area is appropriate. The proposed hours of operation <br />are similar to other restaurant establishments in the area and would complement <br />retail hours of operation. Given the proposed activities and hours of operation, <br />the proposed use will not impact surrounding uses, or residents across First Street. <br />There will be more than sufficient parking to meet the projected demand and <br />allow sufficient parking for other tenants whose customers would use the parking <br />lot. Parking is easily accessible and the restaurant has been designed for <br />barrier-free access. Standard conditions of approval appropriate for uses of this <br />type to ensure that the restaurant/wine bar is operated and maintained in a safe, <br />clean, and appropriate manner. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br /> <br />The City's Municipal Code permits the establishment of restaurants and bars (with <br />a conditional use permit) in selected commercial areas. Because the proposed <br />restaurant will be serving alcohol after 10:00 PM, the Municipal Code classifies it <br />as a bar. The restaurant/wine bar will be operated in accordance with all the <br />provisions of the Municipal Code as they relate to restaurants and bars, and will <br />be operated according to conditions of approval recommended by staff for such <br />uses. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project. <br /> <br />WHEREAS, the Planning Commission determined that the proposed Vineyards wine bar and <br />restaurant will be compatible with the surrounding businesses and will not <br />adversely impact other uses and properties. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-97-24, the application of Terry and Carolyn Yee/The <br />Vineyards for a conditional use permit to serve alcoholic beverages after <br />10:00 p.m. at the Vineyards Restaurant located at 30 West Neal Street, Suite 110, <br />subject to the conditions shown in Exhibit "B," attached hereto and made part of <br />this case by reference. <br />
