PC-97-46 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF TERRY AND CAROLYN YEE/THE <br />VINEYARDS, AS FILED UNDER CASE UP-97-24 <br /> <br />WHEREAS, Terry and Carolyn Yee/The Vineyards, has applied for a conditional use permit to <br />serve alcoholic beverages after 10:00 p.m. at the Vineyards Restaurant located at <br />30 West Neal Street, Suite 110; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - C-O <br />(Commercial-Office) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of May 28, 1997, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which the site <br />is located. <br /> <br />The PUD zoning district in which this restaurant/wine bar is proposed refers to the <br />Municipal Code for its permitted and conditionally permitted uses. The PUD <br />hence allows bars as a conditional use. The purpose of this PUD is to allow a <br />combination of commercial and office type uses. Restaurants, and restaurants <br />which serve alcohol after 10:00 PM (bars), are considered a compatible use within <br />the commercial district and Downtown area of the City. The location of the <br />proposed restaurant/wine bar is in accordance with the objectives of the <br />commercial districts ofthe Municipal Code to provide areas for commercial <br />establishments to concentrate for the convenience ofthe public. The C-C district <br />also encourages more intensive development in the Downtown area. The <br />restaurant/wine bar would be located in an area easily accessible to the public and <br />in an area with many retail stores and other restaurants. However, the restaurant <br />is located a sufficient distance from the nearest residential area so that noise, <br />parking, or other land use conflicts would not spill over to that neighborhood. <br />The use permit for the restaurant/wine bar is in accordance with the objectives of <br />the zoning district. <br /> <br />B. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br />
