<br />PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-97-44 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF RICKIE SLOMINSKI (ONE PARK <br />AVENUE), FOR A CONDITIONAL USE PERMIT, AS FILED UNDER CASE UP-97-22 <br /> <br />WHEREAS, Rickie Slominski (One Park Avenue), has applied for a conditional use permit to <br />operate massage therapy services within an existing beauty salon, One Park Avenue, <br />located in the Meadow Plaza Shopping Center at 3120 Santa Rita Road; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - C (Commercial) <br />District; and <br /> <br />WHEREAS, at their duly noticed public hearing of May 28, 1997, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the City <br />staff concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose ofthe district in which the site is <br />located. <br /> <br />Some of the objectives ofthe zoning ordinance are to foster a harmonious, <br />convenient, workable relationship among land uses, protect existing land uses from <br />inharmonious influences and harmful intrusions, and to insure that public and private <br />lands are used for the purposes which are most appropriate and beneficial to the City <br />as a whole. As proposed, the therapeutic massage services in the existing beauty <br />salon would not interfere with the operations of the surrounding uses and would not <br />alter the existing design of the building. The site of the proposed use is located in the <br />Meadow Plaza Shopping Center, which permits a variety of commercial and retail <br />uses. The anticipated small number of clients will not generate any unusual demands <br />on existing parking for the building or its surrounding uses. <br /> <br />B. The proposed location of the conditional use and the conditions under which <br />it would be operated or maintained will not be detrimental to the public health, safety, <br />or welfare, or materially injurious to the properties or improvements in the vicinity. <br /> <br />The proposed therapeutic massage services within the existing beauty salon would be <br />contained completely on-site. Sufficient parking and traffic capacity have been <br />provided. Professional massage facilities tend to be quiet and do not subject <br />surrounding uses to heavy traffic, hazardous odors, or other objectionable influences. <br />The conditions of approval for this project will ensure that the establishment of this <br />business remain within the standards of all applicable City codes. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br />
