Mitigation Monitoring and Reporting Program (MMRP) prepared for the proposed Project <br />as set forth in the 2023-2031 (6th Cycle) Housing Element Update Program EIR CEQA <br />Guidelines, and as updated in the Project’s Section 15183 Consistency Checklist, dated <br />“Received” March 12, 2025, and kept on file in the Planning Division of the Community <br />Development Department. <br /> <br />g. The Draft Affordable Housing Agreement for City Council approval (“Affordable Housing <br />Agreement”). <br /> <br />THIS APPROVAL IS GRANTED SUBJECT TO THE FOLLOWING CONDITIONS: <br /> <br />1. APPROVAL AND REVISIONS: The proposed Project shall be in substantial conformance <br />with the “Project Plans”, except as modified by the following conditions. Minor changes to <br />the Project Plan(s) may be allowed if requested by the applicant and subject to the <br />approval of the Director of Community Development, so long as the requested change is <br />found to be in substantial conformance with the approved exhibits of the Project Plans. <br />Planning Division approval is required before any changes are implemented in site <br />design, grading, architectural design, house colors or materials, green building measures, <br />landscape material, etc. <br /> <br />2. EXPIRATION: Housing Site Compliance Review shall lapse and be void one (1) year <br />following the effective date of approval unless: <br />a. Prior to the expiration of one year, a building permit is issued and construction is <br />commenced and diligently pursued to completion; or <br />b. Prior to the lapse of the Housing Site Compliance Review approval, applicant has filed <br />a request for an extension pursuant to PMC Section 18.12.030; or <br />c. Otherwise provided by state law. <br /> <br />The Vesting Tentative Map shall expire 2 years after approval or conditional approval of <br />the tentative map, unless: <br />a. Prior to the expiration of the vesting tentative map, the applicant has applied for an <br />extension pursuant to PMC Section 19.20.140 or the Subdivision Map Act; or <br />b. Otherwise provided by state law. <br /> <br />3. CONDITIONS OF APPROVAL CHECKLIST: The applicant shall submit a “Conditions of <br />Approval Checklist” indicating all conditions set forth herein have been satisfied, <br />incorporated into the building permit plans or improvements plans, and/or otherwise <br />addressed. Said checklist shall be incorporated as one of the first four plan sheets of all <br />building permit and engineering permit plan submittals for review by the City prior to <br />issuance of permits. <br /> <br />4. APPEAL PERIOD: The building permit submittal will only be accepted after completion of <br />the appeal period or review period for the Housing Site Compliance Review and VTM as <br />provided in the Pleasanton Municipal Code unless the applicant submits a signed <br />statement acknowledging the plan check fees may be forfeited in the event the approval <br />is overturned on appeal, or by review of the City Council, or the design is significantly <br />changed as a result of the appeal.
