P23-0480 and Tract 8680 PC-2025-09, April 23, 2025 <br />2 <br /> <br />WHEREAS, the Project includes a State Density Bonus Law Request Letter which requests <br />19 waivers and one incentive/concessions to the City’s objective standards and <br />requirements, including, but not limited to, the Pleasanton Municipal Code (PMC) <br />and Objective Design Standards (ODS) requirements; and <br /> <br />WHEREAS, pursuant to PMC Chapter 17.44 – Inclusionary Housing (Inclusionary Zoning <br />Ordinance), approval of an Affordable Housing Agreement is required to <br />document the means by which the project will comply with the Ordinance, <br />including a proposed alternative means of compliance to allow for alternative <br />timing for construction of the affordable housing units, subject to City Council <br />review and approval; and <br /> <br />WHEREAS, at its duly noticed public meeting of April 23, 2025, the Planning Commission <br />considered the written agenda report, public testimony, relevant exhibits, and <br />staff recommendations. <br /> <br />NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City of Pleasanton <br />that prior to taking action on the Project, and at a properly noticed public meeting, <br />the Planning Commission reviewed written and oral staff report, conducted a <br />public hearing on the Project and took testimony, and received into the record all <br />pertinent documents related to the Project (collectively, the “Record Evidence”). <br />The Planning Commission’s determination is based on the Record Evidence, <br />which is incorporated into this Resolution by reference. <br /> <br />BE IT FURTHER RESOLVED by the Planning Commission of the City of Pleasanton: <br /> <br />Section 1: California Environmental Quality Act Findings: <br />Pursuant to CEQA Guidelines, an EIR was prepared and certified by the City on January 26, <br />2023 (City of Pleasanton 2023-2031 6th Cycle Housing Element Update Program Final <br />Environmental Impact Report, SCH No. 2022040091 (Housing Element Update FEIR), and a <br />Mitigation Monitoring and Reporting Program (MMRP) and related findings were adopted in <br />connection therewith. <br /> <br />A Consistency Checklist has been prepared pursuant to CEQA Guidelines Section 15183 <br />(Projects Consistent with a Community Plan or Zoning) (Attachment 2) to determine whether <br />the proposed project requires additional environmental review. CEQA Guidelines Section <br />15183 mandates that projects that are consistent with the development density established by <br />existing zoning, community plan, or general plan policies for which a FEIR was certified (in this <br />case the Housing Element Update FEIR) shall not require additional environmental review, <br />except as might be necessary to examine whether there are project -specific significant effects <br />that are peculiar to the project or its site. The Planning Commission finds it has independently <br />reviewed and analyzed the 15183 Consistency Checklist prepared for the Project pursuant to <br />the City of Pleasanton 2023-2031 (6th Cycle) Housing Element Update Environmental Impact <br />Report (SCH# 2022040091) (Housing Element Update Final EIR or FEIR) and has considered <br />the information contained therein, prior to recommending approval of the Project. <br />Docusign Envelope ID: 2B93F64A-C49E-4C2A-BF54-785F6FDA6546
