Project Specific Condition <br /> <br />10.a. HOMEOWNERS ASSOCIATION: The applicant shall prepare the CC&Rs which shall <br />create a Homeowners’ Association (“HOA”) to govern the single-family residential <br />component of the Project. The CC&Rs shall describe the maintenance areas and <br />responsibilities for the single-family residential component of the Project, which shall be <br />consistent with the maintenance exhibit dated Received on March 24, 2025, on file with <br />the Planning Division of the Community Development Department . The portions of the <br />CC&Rs that are relevant to condition compliance hereunder are subject to review and <br />approval by the Public Works Department and Community Development Department to <br />confirm compliance with this COA 10, prior to recordation of the final map. The CC&Rs <br />shall describe the maintenance responsibilities of all private utilities, public streets and <br />sidewalks, landscaping, trails, bioretentions, street lights, open space, and the HOA- <br />owned park that primarily serves the residential development, but shall also be open to <br />the public. The CC&Rs shall include exhibits showing the location of all the improvements <br />to be maintained by the HOA. Notwithstanding the foregoing, the applicant shall have the <br />right to request the formation of, or inclusion in, a Mello Roos Community Facilities <br />District (Gov’t Code §§ 53311- 53368.3) or other similar financing mechanism. MULTI-FAMILY RESIDENTIAL MAINTENANCE RESPONSIBILITIES: The applicant, or <br />any successor in interest, shall be solely responsible for the maintenance areas for the <br />multi-family residential component of the Project, including but not limited to the <br />maintenance responsibilities of all private utilities, public streets, sidewalks, walkways, <br />landscaping, trails, bioretentions, streetlights, open space, and parking lots. SMOKING RESTRICTION: The multiple-family residential units shall comply with <br />Pleasanton Municipal Code (PMC) Chapter 9.27 Restrictions on Smoking at <br />Condominiums, Townhomes and Buildings With Three or More Attached Units.
