EXHIBIT B <br />DRAFT CONDITIONS OF APPROVAL <br /> <br /> PUD-40, R. J. Wilson/Delco Builders <br />Vineyard Avenue, west of 2500 Vineyard Avenue, <br />in the Vineyard Avenue Corridor Specific Plan Area <br /> <br />January 4, 2005 <br /> <br />The proposed development shall be in substantial conformance to the development <br />plans, Exhibit A, dated "Received, August 11, 2004," Geotechnical Investigation <br />report dated "Received, November 9, 2004," Color/Material board dated "Received <br />November 9, 2004," on file with the Planning Department, except as modified by the <br />following conditions. Minor changes to the plans may be allowed subject to the <br />approval of the Planning Director if found to be in substantial conformance to the <br />approved exhibits. <br /> <br />The project developer shall obtain a building permit from the Building Department <br />and any other applicable City permits for the project prior to the commencement of <br />any construction. <br /> <br />The project developer shall pay any and all fees to which the property may be <br />subject prior to issuance of a building permit. The type and amount of the fees shall <br />be those in effect at the time the building permit is issued. <br /> <br />The PUD development plan approval shall lapse two years from the effective date of <br />this ordinance unless a building permit is obtained and construction diligently <br />pursued, unless otherwise vested by an approved development agreement for the <br />property. <br /> <br />The project developer shall submit a final lighting plan for the building site and site <br />covered by this approval to the Planning Director for review and approval before <br />issuance of building permits. All outdoor lighting shall be low intensity, cut-off <br />style fixtures and shall be directed away from adjacent residences. <br /> <br />This PUD development shall be subject to the permitted and conditional use of the <br />LDR (Low Density Residential) and Open Space Districts, as provided in the <br />Vineyard Avenue Corridor Specific Plan. <br /> <br /> <br />
