Page 1 of 3 <br />Item #4 <br /> CITY COUNCIL AGENDA REPORT <br /> <br />March 4, 2025 <br />Fire <br /> <br />TITLE: PUBLIC HEARING: ADOPT A RESOLUTION DECLARING THAT WEEDS, DIRT, <br />RUBBISH, AND REFUSE UPON OR IN FRONT OF SPECIFIC DESCRIBED <br />PROPERTIES WITHIN THE CITY CONSTITUTE PUBLIC NUISANCES AND THAT <br />THEY BE ABATED, AND SET A PUBLIC HEARING FOR APRIL 15, 2025, <br />REGARDING THE ABATEMENT <br /> <br />SUMMARY <br />The Livermore-Pleasanton Fire Department (LPFD) Weed Abatement Program is a critical fire <br />prevention program. The goal of the program is to prevent the loss of life and property due to <br />uncontrolled wildfire in the urban/wildland interface through a working partnership between <br />property owners and LPFD. Staff will begin notifying property owners upon adoption of the <br />resolution. Abatement not completed by property owners prior to May 31, 2025, will be subject <br />to enforcement by the City's contractor. <br /> <br />RECOMMENDATION <br />Adopt a resolution declaring that weeds, dirt, rubbish, and refuse upon or in front of specific <br />described properties within the city constitute public nuisances and that they be abated. Set a <br />public hearing for April 15, 2025, regarding the abatement of these nuisances and order the <br />abatement thereof by May 31, 2025. <br /> <br />BACKGROUND <br />In Pleasanton, the Livermore-Pleasanton Fire Department (LPFD) combats fire hazards <br />resulting from the overgrowth of grasses, weeds, shrubbery, and trees through the LPFD <br />Weed Abatement Program. This program has been established in compliance with <br />Government Code sections 39560-39588. The LPFD Weed Abatement Program’s goal is to <br />establish a fire-safe community through property owners’ voluntary compliance with the <br />LPFD’s weed abatement standards. <br /> <br />Weed abatement involves the following steps, the first of which is addressed in the resolution <br />that accompanies this agenda report: <br /> <br />1. Inspection, Declaration of Nuisance, and Notification: Identify parcels that are or may <br />become hazardous due to an overgrowth of grasses, weeds, shrubbery and trees and/or the <br />presence of dirt, refuse and rubbish. Identified properties are presented to the City Council. <br />The City Council reviews the list and declares that some or all of the parcels are public <br />nuisances requiring abatement. The City Council may also find and declare that weeds on <br />specified parcels are seasonal and recurrent nuisances. Property owners are given notice to <br />abate the nuisance on their properties. <br /> <br />2. Protest Hearing and Order to Abate: The City Council hears and considers all objections <br />to the abatement proposed and then orders abatement by a contractor. <br />Page 12 of 56
