Prior to the issuance of grading permits for Lots 18 , 19 , 21 , 22, 24 , 26, 27, 28, 32 , and 33 , a <br />qualified biologist shall determine , through the formal Section 404 wetlands delineation process, <br />the extent of jurisdictional wetlands on each lot. Authorization of a Section 404 permit shall be <br />secured from USACE, and a Section 1603 agreement shall be secured from CDFG, if <br />applicable . As part of the permitting process , mitigation of impacts to jurisdictional wetlands <br />shall be identified and implemented. The acreage shall be replaced or rehabilitated on a <br />"no-net-loss" basis in accordance with USACE regulations . Habitat restoration, rehabilitation, <br />and/or replacement shall be at a location and by methods agreeable to USACE . <br />If future fencing is desired along the winding creek which separates Lot 20 from Lot 21, the <br />City should work closely with the owners of both lots to ensure that the fence doe s not interfere <br />with the proper maintenance of the creek and movement of wildlife . A landscape buffer shall <br />be maintained in this area to protect wildlife movement and screen development on Lot 21 from <br />Lot 20. <br />C. WILDLIFE <br />1. In an effort to protect potential red-legged frog species in the Plan Area, all <br />grading plans shall include a minimum 100-foot setback from seasonal ponds that <br />are not identified for development in the Specific Plan . The above wetlands <br />requirements identify all wetlands that would be disturbed with site development , <br />and Exhibit 4.4-1 of the Draft Environmental Impact Report prepared for the <br />project identifies intermittent drainages and other seasonal wetlands . Construction <br />activity occurring within 100 feet of an intermittent drainage may occur only if <br />the drainage is completely dry. <br />2 . All grading plans will include a rrurumurn 100-foot setback from suitable <br />California tiger salamander breeding habitat (i.e ., seasonal pond) that is not <br />identified for development in the Specific Plan . The above wetlands requirements <br />identify all wetlands that would be disturbed with site development , and <br />Exhibit 4.4-1 of the Draft Environmental Impact Report prepared for the project <br />identifies intermittent drainages and other seasonal wetlands. For the upland <br />habitat of the California tiger salamander that would be removed with <br />development of the proposed project, an equivalent amount of upland habitat area <br />shall be preserved within the Plan Area . Suitable tiger salamander habitat in the <br />Plan Area includes all areas identified as blue oak woodland or annual grassland. <br />The preserved habitat shall consist entirely of blue oak woodland or annual <br />grassland habitat. All preserved habitat shall be managed and protected , in <br />perpetuity , as natural habitat. <br />3 . To protect the riparian habitat associated with the Arroyo del Valle , a 100-foot <br />setback shall generally be established from the top of the south bank of the <br />Arroyo del Valle.
