aware of the nearby location and potential impacts of agricultural operations prior to moving to <br />the area . In order to help ensure protection, the recorded deed of sale of all subdivided parcels , <br />and all property rental/lease agreements within the Plan Area shall include a statement to be <br />signed by the future owner/tenant stating that: <br />"You are hereby advised that this property is located near land zoned and/or used <br />for agricultural purposes. Agricultural use is defined as including but not limited <br />to day and night time activity relating to livestock grazing, the keeping of <br />livestock , the growing and processing of agricultural crops, and any commercial <br />agricultural practices performed as incidental to or in conjunction with such <br />operations . Some of the impacts associated with agricultural use include but are <br />not limited to noise , odors , dust, chemicals , refuse , waste , unsightliness , use of <br />agricultural equipment, and traffic . Permitted agricultural pursuits conducted in <br />accordance with good practice and maintenance are not deemed by the City of <br />Pleasanton to be a nuisance. " <br />E. AGRICULTURAL MITIGATION FEE <br />Lots 18 through 28 , 32, and 33 are included within the South Livermore Valley Area Plan <br />boundary and are further situated within a subarea of the Area Plan designated as the "Vineyard <br />A venue Transitional Area." One of the provisions of the Area Plan requires the payment of a <br />fee for certain development that occurs within certain portions of "transitional areas." The <br />purpose of the fee is to ensure that urban development compensates for the loss of cultivable or <br />potentially cultivable soils through the payment of agricultural mitigation fees to fund the South <br />Livermore Valley Agricultural Land Trust. Consistent with this provision , fees are to be <br />collected by the City and distributed to the Land Trust at the time of subdivision map recordation <br />for urban development projects proposed on Lots 18 through 28 , 32 , and 33. Fees are currently <br />calculated based on a one-to-one ratio between the cost per acre for agricultural easements to <br />the Trust and the net acreage of potentially cultivable soils less than 25 percent in slope lost to <br />development. <br />F. CONSTRUCTION ACTIVITIES <br />Construction activity requirements are presented below which are intended to ensure that future <br />development proceeds safely and efficiently . <br />1. Construction Timin2 <br />Construction of housing , roads, other infrastructure , and other site improvements shall <br />be limited to the hours of 8 :00 a.m. to 5 :00 p.m., Monday through Saturday. <br />48
