<br /> <br /> <br /> <br />P21-1173, PUD-146, and Tract 8631 PC-2024-17, October 23, 2024 <br /> <br />2 of 34 <br /> <br />NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City of <br />Pleasanton, based on the entire record of proceedings, including the oral and written agenda <br />reports and all public comment and testimony: <br /> <br />Section 1: Recommended Findings for California Environmental Quality Act (CEQA) <br />With respect to CEQA, the Planning Commission finds it has independently reviewed and <br />analyzed the September 2024 Addendum to the Downtown Specific Plan Final Environmental <br />Impact Report (“DSP FEIR”)(SCH# 2001032014) and has considered the information <br />contained therein, prior to recommending approval of the Project. The Planning Commission <br />further finds the Addendum to the DSP FEIR satisfies the requirements of CEQA and <br />represents the independent judgment and analysis of the City of Pleasanton as le ad agency <br />for the Project. <br /> <br />The Planning Commission recommends the City Council make the following findings : <br /> <br />1. There have not been any substantial changes in the Project that require major <br />revisions of the DSP FEIR because of new significant effects or a substantial <br />increase in the severity of previously identified significant effects; <br /> <br />2. There have not been any substantial changes with respect to the circumstances <br />under which the Project is undertaken that require major revisions of the DSP <br />FEIR due to the involvement of new significant environmental effects or a <br />substantial increase in the severity of previously identified significant effects; and <br /> <br />3. There is no new information of substantial importance, which was not known and <br />could not have been known with the exercise of reasonable diligence at the time <br />the DSP FEIR was certified as complete, that shows any of the following: (a) the <br />project will have one or more significant effects not discussed in the DSP FEIR; <br />(b) significant effects previously examined will be substantially more severe than <br />shown in the DSP FEIR; (c) mitigation measures or alternatives previously found <br />not to be feasible would in fact be feasible and would substantially reduce one or <br />more significant effects of the project, but the project proponents decline to adopt <br />the mitigation measure or alternative; or (d) mitigation measures or alternatives <br />which are considerably different from those analyzed in the DSP FEIR would <br />substantially reduce one or more significant effects on the environment, but the <br />project proponents decline to adopt the mitigation measure or alternative. <br /> <br />Based upon the evidence submitted, none of the conditions described in CEQA Guidelines <br />Section 15162 calling for the preparation of a subsequent EIR or negative declaration have <br />occurred. <br /> <br />In accordance with CEQA Guidelines Section 15164, the Planning Commission recommends <br />that based upon the substantial evidence in the entire record, the City Council adopt , the <br />September 2024 Addendum to the DSP FEIR (SCH# 2001032014) because only minor <br />technical changes or additions are necessary (a change in use is proposed as allowed by the <br />Docusign Envelope ID: 1C31F480-26DA-46E0-9342-FE27B8023A42
