LIABILITY AND INDEMNIFICATION: To the extent permitted by law, the project <br />applicant shall hold harmless, defend (with counsel acceptable to the City), and <br />indemnify the City, its City Council, its officers, commissions, employee and agents from <br />and against any claim, action, or proceeding brought by a third party against the <br />indemnified parties and/or the applicant to attack, set aside, or void the approval of the <br />project or any permit authorized hereby for the project, including without limitation, <br />reimbursing the City its attorneys’ fees and costs incurred in defense of the litigation. <br />The City may, in its sole discretion, elect to defend any such action with attorneys of its <br />choice. <br /> <br />PLANNING DIVISION – 925-931-5600 <br /> <br />Site Development, Uses, and Building Design – Residential and Commercial <br /> <br />6. DEVELOPMENT STANDARDS AND USES – NEW SINGLE-FAMILY HOMES: The <br />project site shall be developed in accordance with the approved PUD Development Plan <br />as shown on the Approved Plans referenced herein. Accessory structures are not <br />allowed, and additions and/or expansions are not permitted to any of the new 14 single - <br />family homes and lots. All other permitted and conditionally permitted uses for the <br />detached, single-family homes shall be those found in Section 18.32 of the Pleasanton <br />Municipal Code (PMC). Accessory dwelling units and/or junior accessory dwelling units <br />may be permitted in accordance with state law and the Pleasanton Municipal Code. <br />Project Specific Condition. <br /> <br />7. DEVELOPMENT STANDARDS AND USES – EXISTING SINGLE-FAMILY HOME (493 <br />ST. JOHN STREET): The project site shall be developed in accordance with the <br />approved PUD Development Plan as shown on the Approved Plans referenced herein. <br />Unless otherwise specific in the conditions of approval, all permitted and conditionally <br />permitted uses shall be those found in Section 18.32 of the Pleasanton Municipal Code <br />(PMC) and any future additions/expansions/modifications to the structure and/or site <br />shall be subject to the site development standards of the R-1-10,000 District of the <br />PMC. Project Specific Condition. <br /> <br />8. DEVELOPMENT STANDARDS AND USES – COMMERCIAL STRUCTURES: The <br />project site shall be developed in accordance with the approved PUD Development Plan <br />as shown on the Approved Plans referenced herein. Office and medical uses shall not <br />be allowed and all other permitted and conditionally permitted uses shall be those in the <br />MU-D District found in Chapter 18.46 of the Pleasanton Municipal Code (PMC). Project <br />Specific Condition. <br /> <br />9.
