There have not been any substantial changes with respect to the circumstances under which the Project is undertaken that require major revisions of the DSP FEIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; and 3. There is no new information of substantial importance, which was not known and could not have been known with the exercise of reasonable diligence at the time the DSP FEIR was certified as complete, that shows any of the following: (a) the project will have one or more significant effects not discussed in the DSP FEIR; (b) significant effects previously examined will be substantially more severe than shown in the DSP FEIR; (c) mitigation measures or alternatives previously found not to be feasible would in fact be feasible and would substantially reduce one or more significant effects of the project, but the project proponents decline to adopt the mitigation measure or alternative; or(d) mitigation measures or alternatives which are considerably different from those analyzed in the DSP FEIR would substantially reduce one or more significant effects on the environment, but the project proponents decline to adopt the mitigation measure or alternative. Based upon the evidence submitted, none of the conditions described in CEQA Guidelines Section 15162 calling for the preparation of a subsequent EIR or negative declaration have occurred. In accordance with CEQA Guidelines Section 15164, the City Council finds, based upon the substantial evidence in the entire record, the October 2024 Addendum to the DSP FEIR (SCH# 2001032014) is appropriate because only minor technical changes or additions are necessary (a change in use is proposed as allowed by the DSP, building height and floor area ratios are within the DSP requirements, parking spaces exceed required parking under the DSP) and none of the conditions described in Section 15162 calling for preparation of a subsequent EIR or negative declaration have occurred with respect to the proposed mixed use project. SECTION 2. This resolution shall become effective immediately upon its passage and adoption.
