Resolution No. 2025-001 <br /> Page 2 of 2 <br /> 2. There have not been any substantial changes with respect to the circumstances under <br /> which the Project is undertaken that require major revisions of the DSP FEIR due to <br /> the involvement of new significant environmental effects or a substantial increase in <br /> the severity of previously identified significant effects; and <br /> 3. There is no new information of substantial importance, which was not known and <br /> could not have been known with the exercise of reasonable diligence at the time the <br /> DSP FEIR was certified as complete, that shows any of the following: (a) the project <br /> will have one or more significant effects not discussed in the DSP FEIR; (b) significant <br /> effects previously examined will be substantially more severe than shown in the DSP <br /> FEIR; (c) mitigation measures or alternatives previously found not to be feasible would <br /> in fact be feasible and would substantially reduce one or more significant effects of <br /> the project, but the project proponents decline to adopt the mitigation measure or <br /> alternative; or(d) mitigation measures or alternatives which are considerably different <br /> from those analyzed in the DSP FEIR would substantially reduce one or more <br /> significant effects on the environment, but the project proponents decline to adopt the <br /> mitigation measure or alternative. <br /> Based upon the evidence submitted, none of the conditions described in CEQA Guidelines Section <br /> 15162 calling for the preparation of a subsequent EIR or negative declaration have occurred. <br /> In accordance with CEQA Guidelines Section 15164, the City Council finds, based upon the <br /> substantial evidence in the entire record, the October 2024 Addendum to the DSP FEIR (SCH# <br /> 2001032014) is appropriate because only minor technical changes or additions are necessary (a <br /> change in use is proposed as allowed by the DSP, building height and floor area ratios are within the <br /> DSP requirements, parking spaces exceed required parking under the DSP) and none of the conditions <br /> described in Section 15162 calling for preparation of a subsequent EIR or negative declaration have <br /> occurred with respect to the proposed mixed use project. <br /> SECTION 2. This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> PASSED, APPROVED, AND ADOPTED by the City Council of the City of Pleasanton at a <br /> regular meeting held on January 9, 2025. <br /> I, Jocelyn Kwong, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on the 9th day of January 2025, <br /> by the following vote: <br /> Ayes: Councilmembers Eicher, Gaidos, Nibert, Testa, Mayor Balch <br /> Noes: None <br /> Absent: None <br /> Abstain: None <br /> Joce Kwo g, Ci Clerk <br /> jad <br /> APR OVED AS TO FORM: <br /> L. <br /> Daniel G.
