Ordinance No. 2287 <br /> Page 2 of 21 <br /> WHEREAS, the City Council held public workshops on May 7, 2024 and August 20, 2024, studied <br /> potential amendments to the inclusionary rate and required affordability levels as stated in the IZO, and <br /> provided direction on various potential amendments to the IZO; and <br /> WHEREAS, on September 11, 2024, the Planning Commission held a duly-noticed public hearing <br /> and considered the written agenda report, relevant exhibits, direction from City Council and <br /> recommendations from City staff concerning the proposed amendments, and received testimony from <br /> interested parties, and recommended City Council approve the proposed amendments. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY <br /> ORDAIN AS FOLLOWS: <br /> SECTION 1. Findings Pursuant to the California Environmental Quality Act (CEQA) <br /> The City Council finds the adoption of this ordinance is not a project within the meaning of Section 15378 <br /> of the California Environmental Quality Act(CEQA) Guidelines because there is no potential for it to result <br /> in a physical change in the environment, either directly or indirectly. Additionally, the ordinance is exempt <br /> from CEQA pursuant to CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that <br /> there is no possibility of a significant effect on the environment and contains no provisions that will directly <br /> or indirectly result in a physical change in the environment. <br /> SECTION 2. Approves Case No. P24-0334 for amendments to Pleasanton Municipal Code <br /> (PMC) Chapters 17.44 (Inclusionary Zoning), 17.40 (Affordable Housing Fee), 18.38 (Housing <br /> Opportunity Zone District) and attached to this ordinance as Exhibit A. <br /> SECTION 3. This ordinance shall become effective 30 days following its passage. <br /> The foregoing Ordinance was introduced at a regular meeting of the City Council of the City of <br /> Pleasanton, California, on November 19, 2024, and adopted on December 3, 2024, by the following vote: <br /> Ayes: Councilmembers Arkin, Balch, Nibert, Mayor Brown <br /> Noes: Councilmember Testa <br /> Absent: None <br /> Abstain: None <br /> Karla Brown, Mayor <br /> ATTEST: <br /> Joc n Kw ng, gity Clerk <br /> APPROVEQ AS TO FORM: <br /> Daniel G.
